Man Severely Injured by Train Near San Diego Convention Center

Man Severely Injured by Train Near San Diego Convention Center

In the early morning hours, just after midnight in the Gaslamp Quarter of downtown San Diego, a man attempted to crawl between stopped freight train cars and was run over as the train began to move. The man suffered a traumatic leg amputation and was rushed to the hospital for emergency treatment.

The incident occurred near the San Diego Convention Center, a busy area with heavy pedestrian traffic, particularly during events and nightlight hours. Alarmingly, this was not an isolated event. A similar injury was reported just months earlier at 5th Avenue and Harbor Drive, where another pedestrian lost a leg under nearly identical circumstances.

These repeated accidents raise urgent questions about the safety of pedestrians in the area and whether local infrastructure or rail operations are contributing to the risk.

If you or a loved one has been injured in a similar incident, speak with one of our San Diego injury attorneys at Singleton Schreiber as soon as possible to understand and explore your rights and legal options.

Repeated Rail Injuries Suggest Systemic Issues

Potentially dangerous, it has become disturbingly common for pedestrians in the Gaslamp Quarter to attempt crossing the train tracks by going around, or even under, stopped trains. Witness footage and reports show that this behavior often stems from frustration or confusion due to the trains’ seemingly abrupt and prolonged stops.

While crossing between train cars is strongly discouraged by authorities, the frequency of these incidents suggests that more than just individual decision-making is at play.

Some key concerns include:

  • Inadequate pedestrian infrastructure near train crossings, especially late at night
  • Unclear or poorly marked pedestrian bridges or overpasses
  • Lack of visible signage or flashing warnings when trains are stopped for extended periods
  • Failure to act on prior incidents involving similar injuries

Who Could Be Held Responsible?

In California, multiple parties may bear some legal responsibility for pedestrian train accidents, even when the injured person made a risky decision. Potentially liable parties include:

  • The city or municipality, for failing to provide a safe or practical pedestrian route
  • Rail companies, for not implementing sufficient safety measures to prevent people from crossing through trains

“When the same type of devastating injury keeps happening in the same area, it’s not just a tragic coincidence; it may be a sign of a systemic safety failure,” says Brett Schreiber, managing partner of Singleton Schreiber personal injury law firm. “Victims and their families deserve answers and accountability, especially when public spaces become risk zones.”

Legal Options for the Victim

California follows a comparative fault system, which means a person who is partially responsible for their own injuries may still recover compensation, although the amount will be reduced by their percentage of fault.

That means even if the injured pedestrian is found to have made a dangerous choice, they may still have a valid claim for compensation if other parties failed to maintain safe infrastructure, provide adequate warnings or barriers, or implement reasonable safety protocols following previous incidents.

Possible damages they may recover could include:

  • Medical expenses for emergency care, surgery, and rehabilitation
  • Lost income due to temporary or permanent disability
  • Pain and suffering caused by trauma and long-term impact
  • Punitive damages, if reckless disregard for safety can be proven

Tour Bus Crash on SR-60 Leaves One Dead, 32 Injured in Hacienda Heights

Tour Bus Crash on SR-60 Leaves One Dead

A devastating crash on State Route 60 in Los Angeles left one person dead and 32 others injured early Sunday morning, May 11, 2025. The collision occurred around 5:00 am in the Hacienda Heights area when a tour bus carrying 63 passengers struck a disabled Nissan Pathfinder that had broken down in a traffic lane.

The impact caused the SUV to erupt into flames, tragically killing its occupant. Authorities have not yet released the victim’s identity. According to California Highway Patrol Officer Zachary Salazar, most of the 32 injured individuals sustained moderate to mild injuries, though two were listed in critical condition.

The bus, en route from Indio to Koreatown, was driven by Sui Sheng Du. After striking the SUV, the vehicle veered across several lanes before colliding with a guardrail. Dramatic footage from CHP shows the bus resting precariously on the shoulder with a shattered windshield and heavy front-end damage.

Officials confirmed that neither drugs or alcohol played a role in the crash. The cause of the SUV’s breakdown remains under investigation.

If you or a loved one was affected by this incident, it’s essential to understand your legal rights and options. Call Singleton Schreiber today to schedule a free consultation with one of our qualified lawyers.

What Causes High-Speed Collisions and Why They’re Dangerous

High-speed crashes involving buses and disabled vehicles are among the most hazardous types of freeway collisions. When a stalled vehicle is left on the roadway, especially in low-light or early morning conditions, it can be nearly impossible for oncoming drivers to avoid.

Common causes of these types of crashes include:

  • Mechanical breakdowns: engine failure, tire blowouts, or battery issues can leave a vehicle stranded in live traffic lanes.
  • Driver visibility issues: poor lighting, early morning fog, or blind curves can delay reaction times.
  • Driver distraction or fatigue: especially relevant for long-distance bus drivers or early morning commuters.
  • Lack of warning or hazard signals: a disabled vehicle without hazard lights or warning triangles may not be seen in time by other drivers.

Why High-Speed Accidents Involving Buses Are Particularly Dangerous

  • Buses have long stopping distances and are less maneuverable
  • Freeway speeds increase the severity of impacts
  • Fires can result from fuel leaks or ruptured batteries, especially when vehicles are stationary and struck from behind
  • Large passenger counts increase the number of people at risk in a single crash

“Crashes like this one underscore just how quickly tragedy can strike,” says Gerald Singleton, managing partner of Singleton Schreiber. “When a vehicle is stranded on a freeway, even a moment’s delay can have deadly consequences. Our firm has helped many families navigate the aftermath of similar collisions, and we are deeply saddened for the loved ones of the person who lost their life and for those injured in this devastating event.”

Legal Recourse for the Victims Affected in the SUV Bus Collision

Both the family of the deceased SUV driver and the injured bus passengers may be entitled to pursue legal action following this tragic event.

Potential legal options may include:

For the deceased SUV driver:

  • Wrongful death claim: the victim’s surviving family members may file a claim against any responsible parties, such as the tour bus company, if negligence is proven.
  • Investigation of vehicle defects: if a manufacturing issue caused the SUV to break down, the vehicle’s manufacturer may also bear responsibility.

For the 32 injured passengers:

  • Personal injury claims: injured passengers may pursue compensation for medical expenses, lost wages, pain and suffering, and other damages.
  • Claims against the bus company: if the investigation reveals the tour bus driver was fatigued, speeding, or otherwise negligent, the bus company could be held liable.
  • Product liability: if injuries were worsened due to seatbelt maintenance or design may face claims.

Each of these cases requires thorough investigation and experienced legal guidance. If you or a loved one was affected by this collision, contact Singleton Schreiber to learn more about your options. Four Utility Workers, Doug Sides, Madison Carter, Will Evans, and Matthew Lockwood Killed in Eden, NC, Dump Truck Crash in a Work Zone

Eden, NC Work Zone Accident

A tragic work zone crash in Eden, North Carolina, claimed the lives of four utility workers on April 24, 2025. Authorities say a City of Eden dump truck, driven by 48-year-old Michael Vernon, plowed into a work zone, fatally striking four linemen and injuring four others, including himself.

The deceased victims have been identified as Doug Sides, Madison Carter, Will Evans, and Matthew Lockwood. All were working near the road when the dump truck entered the area and failed to stop, running over multiple workers. 911 calls from the scene describe the urgency and horror of the moment, with one caller pleading, “We need everyone… five me down.” While others described a possible fire and chaos, as bystanders rushed to help.

Vernon is now facing four counts of misdemeanor death by motor vehicle, as well as charges for failing to stop at a stop sign and operating a commercial motor vehicle without a valid commercial driver’s license (CDL). The City of Eden has since terminated Vernon and two senior public works officials. A full investigation is ongoing, and the National Transportation Safety Board (NTSB) is expected to release a preliminary report soon.

If your loved one was killed or injured in a work zone crash, your family may be entitled to compensation. Contact Singleton Schreiber today for a free consultation.

The Dangers Linemen Face

Utility workers, often called linemen, work in high-risk environments that require strict safety protocols. They spend hours repairing and maintaining power lines in all conditions, which are frequently in or near active roadways where distracted or negligent drivers can turn a routine job into a life-threatening situation.

The dangers linemen face on the job are compounded when basic safety measures are ignored, such as requiring drivers of heavy trucks to hold a valid CDL. Operating a commercial motor vehicle without one is not only illegal, it also puts lives at risk. CDLs are essential for truck drivers to have because:

  • They require rigorous training on vehicle control, safety procedures, and hazard recognition
  • Drivers are required to pass medical exams and undergo background checks
  • Without one, drivers may lack the skills, training, and awareness to safely operate large, heavy trucks

“This crash should have never happened,” says Robert Saunooke, attorney at Singleton Schreiber personal injury law firm. “Our hearts go out to the families of these linemen, who were doing essential work in dangerous conditions. It’s inexcusable for an unlicensed driver to be behind the wheel of a city-owned dump truck, and we are committed to helping the affected victims and families find answers and accountability.”

While early reports point to driver error and the lack of a valid CDL, investigators have not ruled out other contributing factors, such as a possible medical emergency or mechanical failure. A full investigation will be necessary to determine the complete picture of what happened.

What Legal Options Are Available to the Victims and Their Families?

In the aftermath of a catastrophic crash like this, grieving families and injured survivors are left to face not only emotional pain but also overwhelming financial burdens. Fortunately, civil law provides a path toward justice and accountability through personal injury and wrongful death claims.

For the families of Doug Sides, Madison Carter, Will Evans, and Matthew Lockwood, a wrongful death lawsuit may allow them to pursue compensation for:

  • Funeral and burial expenses
  • Lost financial support and future earnings
  • Loss of companionship and emotional suffering

Meanwhile, the utility workers who survived the crash may be entitled to personal injury compensation, including:

  • Medical expense (both immediate and long-term)
  • Lost income due to missed work
  • Pain and suffering
  • Costs related to rehabilitation or permanent disability

It is worth noting that the surviving victims may be eligible for workers’ compensation benefits since the linemen were performing their job duties at the time of the crash. However, workers’ compensation claims do not always fully cover the full extent of damages sustained, which is why a third-party injury claim may be pursued as well.

Dana Point Single Vehicle Crash

A devastating single-vehicle accident in Dana Point, California, claimed the life of a high school student, Rebecca Cespedes, and left five of her classmates injured on Tuesday, May 6, 2025. The crash occurred just before noon on Dana Point Harbor Drive when a pickup truck carrying six juveniles slammed into a tree, according to the Orange County Sheriff’s Department.

Six students from Dana Hills High School were in the truck when the crash took place. Authorities say the driver, 16-year-old Rebecca Cespedes, was pronounced dead at the scene. Two boys and a girl sustained critical injuries and were transported to local hospitals. Two other passengers suffered minor injuries.

It is not yet known whether speed, alcohol, or drugs played a role in the accident, and the incident remains under investigation. Understanding the Causes and Consequences of Single-Vehicle Accidents

Single-vehicle crashes can be just as catastrophic as multi-car collisions. They often result in serious injury or death and leave survivors and families with lasting physical, emotional, and financial burdens.

Common causes of single-vehicle accidents include:

  • Loss of control due to excessive speed
  • Distracted or drowsy driving
  • Mechanical failure or tire blowouts
  • Poor road conditions or hazards
  • Driver inexperience, especially among teen drivers

Even in cases where no other vehicle is involved, outside factors like vehicle defects, road design, or insufficient signage may contribute to the crash. When such circumstances exist, injured passengers or their families may still have grounds for legal claims.

“This accident is heartbreaking, not only because a young life was cut short, but because it has left five families waiting at hospitals,” says attorney Brett Schreiber, partner of the Singleton Schreiber personal injury law firm. “In situations like this, we work closely with families to uncover what happened, determine if any external factors played a role, and help them find a path forward.”

Legal Options for Victims and Families

The surviving victims of this car crash may have legal recourse. California law allows injured parties in single-vehicle accidents to pursue compensation through:

  • The driver’s auto insurance policy, which may provide coverage for passenger injuries
  • Uninsured/underinsured motorist coverage if the driver or vehicle was not adequately insured
  • Product liability claims if a mechanical defect or tire failure contributed to the crash
  • Claims against public entities for hazardous road conditions or inadequate signage, where applicable

Additionally, the family of the deceased driver may pursue wrongful death claims if evidence shows the crash resulted from a defect, roadway hazard, or other external negligence.

Four Hospitalized After Head-On Crash on Hana Highway

Four Hospitalized After Head-On Crash on Hana Highway

A devastating head-on collision on Maui’s Hana Highway left four people hospitalized on the afternoon of Friday, May 2, 2025. The crash occurred around 3:45 pm near Nonohe Place in Spreckelsville and left one person with life-threatening injuries.

According to the Maui Police Department, a black 2007 GMC Sierra truck was traveling eastbound in the westbound lanes while overtaking other vehicles when it collided head-on with a black 2023 Nissan Altima traveling lawfully in its lane. The violent crash seriously injured the driver of the truck, a 52-year-old man from Paia, and the driver of the Altima, a 68-year-old man visiting from Idaho.

Two passengers in the Altima also suffered major injuries. A 73-year-old man sustained serious trauma, while a 63-year-old woman riding in the back seat was reported to have life-threatening injuries. All four individuals were transported to Maui Memorial Medical Center for treatment.

Investigators believe that speed was a factor in the crash. It is not yet known whether drugs or alcohol were involved. The truck’s airbags reportedly did not deploy, while the sedan’s airbags activated properly. All occupants were wearing seatbelts at the time of the collision.

The Deadly Consequences of Head-On Collisions

Head-on crashes are among the most dangerous types of traffic accidents, often resulting in severe or fatal injuries due to the force of impact. Maui’s Hana Highway, known for its scenic views and winding roads, can also be treacherous, especially when drivers act recklessly or attempt dangerous maneuvers.

Common causes of head-on collisions include:

  • Improper passing, such as crossing the center line to overtake slower traffic in unsafe conditions
  • Speeding, which reduces reaction time and increases the severity of crashes
  • Distracted driving, including texting, talking on the phone, or adjusting in-car controls
  • Fatigued driving, which can impair judgment and lead to driving into oncoming lanes
  • Failing to obey road markings or signs, especially on winding or rural roads like Hana Highway

“What happened on Hana Highway is heartbreaking, but unfortunately, accidents like this are not uncommon on this scenic, yet dangerous highway,” says Brett Schreiber, a partner at Singleton Schreiber. “Our team has handled many head-on collision cases, and we understand how devastating they can be for families. We’re committed to helping victims and their loved ones get the support and compensation they need to recover.”

Legal Recourse for Victims of the Hana Highway Collision

Victims of this head-on crash may be entitled to pursue legal action through personal injury claims. Depending on the outcome of the investigation, the at-fault driver could be held liable for damages resulting from negligent behavior, such as reckless overtaking or excessive speed.

Potential compensation may include:

  • Medical expense, including emergency care, surgeries, and rehabilitation
  • Lost wages due to time away from work
  • Pain and suffering caused by physical and emotional trauma
  • Long-term care costs or permanent disability
  • Loss of enjoyment of life

Although financial compensation cannot undo the harm suffered, it can help cover the costs of medical care and provide some measure of relief during the recovery process.

12-Year-Old Emery Chalekian Fatally Struck in Encinitas Crosswalk Accident

Emery Chalekian Fatally Struck in Encinitas Crosswalk Accident

A devastating accident on Friday, April 25, claimed the life of 12-year-old Emery Chalekian after she was struck by a vehicle while crossing the street in a crosswalk. The incident occurred at approximately 6:51 pm at the intersection of Encinitas Boulevard and Village Square Drive.

According to the North Coastal Sheriff’s Station, Chalekian was walking through the crosswalk when she was hit by an SUV. Authorities believe the SUV had just been involved in a collision with another car at the intersection before striking the young pedestrian. Chalekian was pronounced dead at the scene.

Both drivers remained at the location and cooperated with authorities. No injuries to the drivers were reported, and investigators do not believe drugs or alcohol were contributing factors. The crash remains under investigation by the North Coastal Station Traffic Investigators and the Sheriff’s Traffic Accident Reconstruction Team.

If you have lost a loved one in a car vs pedestrian accident, contact Singleton Schreiber for compassionate legal guidance. Our team will work closely with you and your family to help you understand your rights and explore your options.

The Dangers of Pedestrian vs Vehicle Collisions

Pedestrian fatalities remain a persistent public safety issue, especially at intersections where visibility and reaction times can play a critical role. Drivers have a responsibility to remain vigilant and cautious, particularly near crosswalks and during high-traffic hours. Some common ways drivers may cause pedestrian accidents include:

  • Failing to yield at crosswalks even when pedestrians have the right of way
  • Speeding through intersections reduces the ability to stop in time for crossing pedestrians
  • Distracted driving, such as using a cell phone or adjusting in-car systems
  • Running red lights or ignoring traffic signals increases the likelihood of secondary collisions
  • Following too closely or making unsafe lane changes, which can lead to chain reaction crashes
  • Driving too fast for conditions, particularly during low-light hours or bad weather

In this heartbreaking case, the chain of events leading to the crash highlights how even brief lapses in judgment or care can have fatal consequences for vulnerable road users.

“No parent should ever have to endure the loss of a child in a preventable traffic accident,” says Gerald Singleton, managing partner of Singleton Schreiber. “Our firm has seen firsthand how lives can be changed forever in an instant, and we are committed to helping families seek answers, accountability, and justice in the aftermath of these tragedies.”

Legal Options for the Family

Emery Chalekian’s family may have the right to pursue a wrongful death claim against the at-fault parties. Even though both drivers remained at the scene and were reportedly not impaired, the investigation may uncover negligent behavior, such as unsafe speeds, failure to yield, or other traffic violations, that contributed to the fatal crash.

A wrongful death claim may allow the family to obtain compensation for:

  • Funeral and burial costs
  • Pain and suffering endured by surviving family members
  • Loss of companionship
  • And more

While no amount of money can ever bring back their daughter or ease the deep emotional pain of her loss, a successful claim can help provide some measure of financial relief during this devastating time.
