California Mother Adela Magaña Loses Arm After Palm Tree Collapse at Ventura Mini Golf Course

fallen tree

A family’s birthday celebration turned into a life-altering tragedy when a 40-foot palm tree fell on 53-year-old Adela Magaña at the Golf N’ Stuff amusement park in Ventura, California.

On August 6, Adela was seated on a bench watching her husband and children play their third hole when witnesses heard a “screeching sound” followed by a “big thump.” The tree came crashing down, trapping her underneath. Her husband, adult son, and two Good Samaritans lifted the tree off her, only to find her arm severely crushed and bleeding heavily. A tourniquet was applied before paramedics rushed her to Ventura County Medical Center.

Despite emergency surgery, the damage to her nerves and blood vessels was too severe, and her arm was amputated just below the shoulder the following day. She now faces additional surgeries, extensive rehabilitation, and the lifelong challenge of adapting to a prosthetic.

The emotional impact on her family has been profound – especially for her 13-year-old son, who witnessed the accident. The Magaña family says they had visited the mini golf course many times before, making the day’s events all the more shocking.

Golf N’ Stuff has not publicly commented on how or why the tree fell. Questions remain about the safety of the property and whether proper maintenance could have prevented the accident.

Liability in Tree-Fall Incidents

When a tree or large branch falls and causes injury, liability often depends on whether the property owner or manager knew – or should have known – about the hazard and failed to address it. In California, businesses and property owners have a legal duty to maintain their premises in a reasonably safe condition, which includes inspecting and maintaining trees that could pose a risk to guests.

Potentially liable parties in a tree-fall case may include:

  • The property owner for failing to inspect, maintain, or remove dangerous trees.
  • A property management company that was responsible for upkeep and safety inspections.
  • A landscaping or tree maintenance contractor, in cases where negligent work or missed warning signs contributed to the incident.
  • Municipal or governmental entities in situations where the tree was on public land but within the area of the incident.

Adela Magaña and Her Family Have Legal Options | Singleton Schreiber Can Help

According to Brett Schreiber of Singleton Schreiber, these cases come down to proving negligence. “When a tree falls and seriously injures someone, the results are devastating.  If the property owner or management company was negligent, such as ignoring visible signs of structural instability, disease, or decay, the injured party – in this case, Adela Magaña – may be entitled to compensation for medical expenses, lost income, pain and suffering, and long-term care needs.”

“These cases can be extremely complex,” he went on to say, “but we understand how to find the liable parties and hold them accountable.  Mrs. Magaña was injured through no fault of her own, and she deserves justice.  We can help.”

Singleton Schreiber has a demonstrated history of fighting for people injured by falling trees.  The firm has recently recovered $16.4 million for a client who was struck by a large tree branch that fell from a tree on a Department of Transportation-owned and maintained roadway.

Adela Magaña may be entitled to compensation for medical expenses, lost wages, pain and suffering, and more as a result of an incident that should never have happened in the first place.  While a lawsuit cannot undo the harm she suffered, it can hold the responsible party accountable for the unsafe condition, mitigate the financial impact it has on her life, and potentially prevent a similar incident from happening to someone else.

Four Killed in Medical Transport Plane Crash Near Arizona-New Mexico Border

small plane

A tragic plane crash near the Arizona-New Mexico border claimed the lives of four people on the afternoon of Tuesday, August 5, 2025. According to officials, the medical transport aircraft went down near Chinle Airport around 12:40 pm while en route to pick up a patient from a nearby hospital.

The victims, two pilots and two healthcare providers, were all crew members of CSI Aviation, an Albuquerque-based aircraft company. The company confirmed there were no patients or other passengers aboard at the time. The remains of the victims were escorted the following morning by the Navajo Police Department and Apache County Sheriff’s Office to the Green Meadows Funeral Home.

CSI Aviation released a statement expressing deep sorrow and pledging full cooperation with the ongoing investigation being conducted by the National Transportation Safety Board (NTSB), the Federal Aviation Administration (FAA), and local law enforcement. The cause of the crash remains unknown.

If you or a loved one has been affected by an aviation accident, contact Singleton Schreiber today to learn your legal options and seek justice.

The Dangers of Small Aircraft Crashes

Small aircraft crashes, such as the recent medical transport tragedy, can be particularly devastating due to the lack of protective features found in larger commercial planes. These flights often occur in remote or rural areas where emergency response may be delayed, and the impact forces are often severe.

Possible causes of small aircraft crashes include:

  • Mechanical failure – faulty engines, propellers, or other systems can cause a sudden loss of control.
  • Pilot error – mistakes during navigation, landing, or takeoff are a common factor in aviation accidents.
  • Weather conditions – strong winds, low visibility, or sudden storms can make flying dangerous.
  • Maintenance issues – improper inspections or skipped repairs can allow dangerous defects to go unnoticed.
  • Bird strikes or other mid-air hazards – collisions with wildlife or debris can damage critical components.

“Our hearts go out to the families and colleagues mourning the loss of these dedicated crew members,” says Brian Colón, managing partner of Singleton Schreiber New Mexico. “Small aircraft serve vital roles in medical and emergency transport, but they also operate under challenging conditions that can contribute to serious accidents. Factors like mechanical issues, weather, and human error must all be thoroughly examined to determine the cause.”

Potential Legal Recourse for Families

When a fatal aviation accident occurs, families may be entitled to pursue legal action to hold the responsible parties accountable. Liability could fall on multiple entities, including the aircraft operator, the maintenance provider, the aircraft manufacturer, or even government agencies if negligence in oversight played a role.

Families may seek compensation for:

  • Funeral and burial expenses
  • Loss of financial support
  • Loss of companionship and consortium
  • Medical expenses prior to death
  • Pain and suffering

“In cases like this, multiple parties may share responsibility, whether it’s the operator for inadequate safety protocols, a manufacturer for defective components, or others whose negligence played a role,” says Singleton Schreiber partner and attorney Knut Johnson. “Our goal is to help families uncover the truth and obtain the justice and compensation they deserve.”

The Dangers and Causes of Truck Rollovers

Semi-truck rollovers are among the most severe roadway accidents, often leading to serious or life-threatening injuries. Because of the size and weight of commercial trucks, these crashes can also create dangerous situations for other motorists, blocking lanes, spilling cargo, or causing secondary collisions.

Common causes of truck rollovers include:

  • Excessive speed while navigating curves or turns
  • Cargo that shifts during transport due to improper loading
  • Driver fatigue, distraction, or impairment
  • Poor road conditions, debris, or hazardous weather
  • Sudden maneuvers or overcorrection to avoid obstacles

“Rollover accidents involving semi-trucks can change a person’s life in an instant. Our thoughts are with the driver who was airlifted, and we hope for a swift and full recovery,” says Brian Colón, managing partner of Singleton Schreiber. “Our firm is dedicated to uncovering the truth in these cases, whether the cause is driver error, a negligent trucking company, or unsafe road conditions, so that victims can pursue the justice and compensation they need to recover.”

Legal Options for the Injured Truck Driver

The semi-truck driver injured in this rollover may have legal options depending on the cause of the crash and the circumstances surrounding his work. If he was operating the truck as part of his job, he could be entitled to workers’ compensation benefits to cover medical bills, lost wages, and rehabilitation costs. In addition, if a third party’s negligence played a role, such as another motorist, a cargo loading company, or a vehicle maintenance provider, he may be able to pursue a personal injury claim for further compensation.

Potentially liable parties could include:

  • The trucking company, if unsafe scheduling, inadequate training, or poor maintenance contributed to the crash
  • Cargo loaders, if shifting or unsecured freight caused the truck to overturn
  • Vehicle or parts manufacturers, if a mechanical defect was involved
  • Government entities, if dangerous road conditions or poor maintenance played a role

By pursuing these claims, the injured driver could recover compensation for medical expenses, lost income, pain and suffering, and other damages related to the incident.

Tragic 18-Wheeler Crash in Pike County Claims Life of Young Truck Driver Damond K Julien

Crash in Pike County Claims Life of Young Truck Driver Damond K Julien

A devastating crash in the early morning hours of July 30, 2025, claimed the life of a 25-year-old truck driver in Pike County, Mississippi. The incident occurred just before 3:30 am on Interstate 55 South near Exit 15. According to Pike County Coroner Rashad Taylor, the driver, identified as Damond K. Julien of New Orleans, died at the scene. Another individual was airlifted to a hospital with injuries. The McComb Police Department is actively investigating the circumstances surrounding the crash.

Officials reported that the 18-wheeler struck the Park Drive bridge while traveling along I-55. In response, the Mississippi Department of Transportation (MDOT) closed both directions of the bridge until further notice, citing the need to assess the structural safety of the overpass. Drivers in the area have been advised to use alternate routes and remain alert for construction crews working nearby.

If you or someone you love was affected by this crash, contact Singleton Schreiber today to learn more about your options.

The Dangers of 18-Wheeler Crashes and Bridge Collisions

Accidents involving large commercial trucks are often far more dangerous than standard car collisions. Due to their size and weight, 18-wheelers are more likely to cause catastrophic damage when something goes wrong. When these vehicles strike overpasses or other infrastructure, the risk of fatal injuries rises dramatically, not just for the truck driver, but also for nearby motorists and construction workers.

Crashes like this may be caused by several factors, including:

  • Driver fatigue – Long hours on the road without adequate rest can slow reaction times, impair judgment, and make it harder to respond to hazards.
  • Poor visibility – Fog, heavy rain, or darkness can make it difficult for drivers to see road signs, height clearances, or approaching obstacles
  • Faulty GPS directions – Navigation errors can send drivers onto unsuitable routes, such as roads with low bridges that large trucks cannot safely pass under.
  • Unfamiliar routes – Driving in an area the driver doesn’t know well can increase the likelihood of missing important warnings or making unsafe maneuvers.
  • Hazardous road design – Sharp curves, narrow lanes, or poorly maintained infrastructure can pose serious risks to large commercial vehicles.
  • Lack of proper signage – Missing or unclear signs about bridge height or lane restrictions can leave drivers without the information they need to avoid collisions.
  • Inadequate driver training – Trucking companies are responsible for ensuring drivers are trained to handle route planning, height clearance awareness, and safe driving in challenging conditions. Without this training, preventable crashes are more likely to occur.

Legal Options for the Victim’s Family and the Injured Driver

When someone loses their life in a commercial trucking accident, surviving family members may have grounds to file a wrongful death claim against any party whose negligence contributed to the crash. Potentially liable parties could include the trucking company, a vehicle maintenance provider, or a public agency responsible for road and bridge maintenance, especially if the signage, design, or upkeep of the overpass was inadequate.

“Our hearts go out to the family of Damond Julien, whose life was tragically cut short in this crash, and to the family of the driver who was seriously injured,” said Shani Butler-Anderson, a Jackson personal injury lawyer at Singleton Schreiber. “In the aftermath of a fatal trucking accident, it’s critical for families to seek answers and understand their legal rights. A thorough investigation can help determine whether negligence, on the part of the trucking company, vehicle manufacturer, or even public infrastructure authorities, played a role. Legal action can also help hold those responsible accountable and provide financial support during an incredibly difficult time.”

In addition to the deceased driver’s family, the surviving individual who was airlifted from the scene may also have legal options. If the crash was caused by another party’s negligence, the injured party may be able to file a personal injury claim to recover damages. This could include compensation for medical bills, lost wages, long-term care needs, pain and suffering, and more.

Truck accident cases often involve multiple layers of responsibility, and a comprehensive investigation is key to identifying who should be held accountable. On Friday, July 25, 2025, 23-year-old Tiffany Zamora veered into the median while driving on Citracado Parkway in Escondido. Her car collided with a tree. Despite being rushed to Palomar Medical Center, she was pronounced dead later that day.

On Tuesday, July 22, 2025, 87-year-old Agustina Acosta was struck by a pickup truck in a Chula Vista parking structure. The driver hit Acosta while turning a corner in the structure on H Street. She was taken to UCSD Medical Center, where she died shortly after arrival.

Each of these fatal incidents is a devastating loss for the families involved. If you or someone you love has been affected by a serious or fatal crash in the San Diego area, contact Singleton Schreiber to learn how we may be able to help.

What Can Cause Fatal Crashes Like These? Understanding Contributing Factors and Liability

The tragic incidents outlined above represent a wide range of accident types, pedestrian collisions, single-vehicle crashes, and multi-vehicle incidents. Though the details differ, many of these tragedies could involve underlying causes that warrant closer investigation.

Possible contributing factors include:

  • Driver negligence, such as speeding, distraction, or impairment
  • Vehicle defects, including faulty brakes, tires, or steering systems
  • Road hazards or poor infrastructure, like unclear signage, dangerous curves, or inadequate pedestrian crossings
  • Lack of visibility
  • And more

Depending on the specific circumstances, multiple pirates could be held legally responsible:

  • Drivers, if they acted negligently or failed to yield
  • Vehicle manufacturers or parts suppliers, if mechanical failure played a role
  • Property owners or public agencies, for maintaining unsafe roads, parking lots, or pedestrian areas
  • Local or state government entities (such as the City of San Diego, County of San Diego, or Caltrans), if they failed to repair known hazards, install proper signage, or maintain safe roadway conditions
  • Employers, in the case of work-related driving or company-owned vehicles

“These are heartbreaking losses for each of the families involved,” said Gerald Singleton, managing partner of Singleton Schreiber. “Whenever fatal crashes occur, it’s essential to investigate all possible causes. Families deserve answers, and they may have legal options if negligence or preventable dangers were involved.”

Legal Options for Families After Fatal Traffic Accidents

When someone is killed in a traffic accident, surviving family members may have the right to file a wrongful death claim if another party’s negligence or wrongful act contributed to the fatal incident. These claims are not limited to accidents involving multiple vehicles; they can also apply to single-vehicle crashes, pedestrian deaths, and other tragic events where someone failed to act with reasonable care.

To succeed in a wrongful death claim, families must show that their loved one’s death was caused by another party’s negligence, usually with the help of an experienced wrongful death attorney.

Through a wrongful death claim, surviving loved ones may be able to recover compensation for:

  • Funeral and burial expenses
  • Medical costs related to the final injury
  • Loss of financial support or future income
  • Loss of companionship, care, and guidance
  • Emotional pain and suffering

While no legal action can undo the heartbreak of losing a loved one, a wrongful death lawsuit can provide accountability and financial support during an incredibly difficult time.

Joshua Leblanc of Huntsville Killed After Tesla Crashes and Catches Fire in Walker County

ev car

A tragic crash in Walker County, Alabama, claimed the life of a Huntsville man on the afternoon of July 22, 2025. According to the Alabama Law Enforcement Agency, 40-year-old Joshua Leblanc was driving a 2021 Tesla Model 3 when the vehicle veered off Hill Road near Drummond Switch Cut Off Road, approximately two miles south of Empire, at around 2:45 pm.

The Tesla reportedly struck a guardrail and multiple trees before bursting into flames. First responders transported Leblanc’s remains to the Alabama Department of Forensic Sciences, where his identity was later confirmed. At this time, the cause of the crash remains under investigation.

Possible Causes and Liability in Fiery Single-Vehicle Crashes

While the investigation is still ongoing, several possible factors could explain why a vehicle like a Tesla might leave the roadway and catch fire. Crashes of this nature are complex, and it’s critical to consider multiple causes, some of which may involve product failure or third-party negligence.

Potential causes and contributing factors may include:

  • Vehicle malfunction, such as brake failure, steering defects, or battery issues
  • Driver error, including distracted driving, fatigue, or speeding
  • Defective vehicle design, especially related to crashworthiness or fire risk in EVs
  • Roadway hazards, like sharp turns, inadequate signage, uneven pavement, or poorly placed or designed guardrails

Any of these factors could point to legal responsibility beyond just the driver. Depending on the findings of the investigation, potentially liable parties might include:

  • The vehicle manufacturer for defects in design or production
  • A parts supplier if a specific component failed
  • Government agencies or contractors responsible for maintaining a safe roadway
  • Other drivers, if another vehicle’s actions forced the Tesla off the road

“Our hearts go out to Mr. Leblanc’s family as they grieve this sudden and heartbreaking loss,” said Danielle Mason, attorney at Singleton Schreiber. “When accidents involve potential vehicle defects or unexplained fires, it’s important to conduct a thorough investigation. Families deserve to know whether a mechanical issue, manufacturing error, or another party’s negligence played a role, and if so, they may have the right to pursue justice for their loved one.”

Legal Options for the Family of Joshua Leblanc

In the aftermath of a fatal accident like this, surviving family members may have the right to pursue a wrongful death claim. If the crash or resulting fire was caused by a defective vehicle component or the vehicle’s failure to protect the occupant during impact, a product liability lawsuit against the automaker or parts manufacturer may be appropriate. Alternatively, if a dangerous road condition or negligent maintenance contributed to the incident, a government agency or contractor could bear some responsibility.

A successful legal claim may help families recover compensation for medical and funeral expenses, emotional suffering, and the loss of financial support and companionship. Singleton Schreiber recently secured a $243 million verdict in a case where Tesla’s Autopilot feature contributed to a fatal crash in Florida, highlighting our firm’s deep experience handling complex cases involving electric vehicles.
