Three People Injured in Fiery Ocean Beach Motorcycle Crash

Three People Injured in Fiery Ocean Beach Motorcycle Crash

SAN DIEGO — A motorcyclist and his passenger were both seriously injured Tuesday after a crash in Ocean Beach that ejected the passenger from the bike.

Three People Injured in Fiery Ocean Beach Motorcycle CrashThe motorcyclist, 42, was traveling west on Voltaire Street shortly after 4:30 p.m. when he ran into the back of a Honda CR-V stopped at a stop sign at the intersection of Bacon Street, San Diego police said.

The BMW motorcycle caught fire, leaving the rider with burns that police called life-threatening. His passenger, 38, was thrown from the bike and suffered a pelvic fracture, as well as a large laceration to her scalp. Both were taken to a local hospital for treatment.

Police said the driver of the Honda, a 49-year-old man, complained of back pain after the collision.

While the investigation is ongoing, officers believe that alcohol intoxication may have been a factor in the crash.

“My thoughts are with everyone involved in this accident,” said Brett Schreiber, a partner at Singleton Schreiber and a longtime Ocean Beach resident. “Hopefully the medical professionals that treat them are able to get them on track for quick recoveries.”

Alcohol and motorcycles are an extremely dangerous mixture.

Data compiled by the National Highway Traffic Safety Administration shows that motorcycle riders are routinely overrepresented in fatal crashes, representing just 1% of total vehicle miles traveled but 15% of traffic fatalities.

In all, more than 6,200 people were killed in crashes while riding in 2022, the highest number since at least 1975.

Adding alcohol to that mix only further spikes the level of danger involved, with reaction times proven to start declining at a blood alcohol content of 0.02% — well before the threshold for DUI in every state.

“If you are injured in a crash that involves a driver who has been drinking,” Schreiber said, “you should consider consulting a personal injury attorney. We’re there to assess the legal options that you have available to you, to make sure that you recover the money that you deserve for unexpected expenses like medical bills or lost wages.”

Driver Hospitalized After Being Pinned Between Two Semi-trucks in Crash

Driver Hospitalized After Being Pinned Between Two Semi-trucks in Crash

FRESNO, Calif. — A driver was hospitalized with major injuries after a collision that involved multiple semi trucks just over a week ago.

Driver Hospitalized After Being Pinned Between Two Semi-trucks in CrashCalifornia Highway Patrol officers said they were called to a crash in the northbound lanes of Highway 99 just north of Highway 41 in Fresno shortly before 4:15 p.m. May 15.

Police determined that a Ford F-250 utility was stopped behind one semi due to heavy traffic in the area when another semi, which failed to stop for traffic, struck the Ford from behind, pushing it into the other semi.

The driver of the Ford, which was crushed between the two semis, was pinned in place and had to be extricated by rescue crews in order to be transferred to a local hospital for treatment of serious injuries.

CHP has not released further information about the crash, including the identity of the Ford driver or whether any other factors contributed to the collision.

“Our thoughts are with the driver who was injured in this crash and his family,” said Brett Schreiber, an attorney at Singleton Schreiber. “An accident like that exerts a terrible toll, both physically and mentally, and I hope that his treatment is successful.”

Crashes involving large trucks are getting more common.

More than 120,000 large trucks were involved in crashes that resulted in injury or death in 2022, according to data from the National Highway Traffic Safety Administration, with more than 60% of truck crashes happening during daytime hours.

The rate of fatal crashes per 100 million truck miles has increased 37% over the past decade, while the rate of crashes causing injury per 100 million miles is up approximately 6% since 2016 (the government changed its sampling process in 2016, so comparisons to earlier years are less accurate).

“When large trucks are involved in crashes, the aftermath can be very complex,” Brett Schreiber said. “A personal injury attorney can help you pursue legal options to make sure that you are compensated for unexpected expenses like medical bills or lost wages, so you can focus on recovering and getting back to your life.”

San Ysidro Apartment Fire Leaves One Injured

San Ysidro Apartment Fire Leaves One Injured

Sunday, May 19th, a fire broke out at a San Ysidro apartment complex, injuring one person. The fire took place at the Milejo Village apartments, an affordable housing development that just opened back in November 2023. The building provides aid and support for those facing mental health challenges and homelessness.

San Ysidro Apartment Fire Leaves One InjuredJust before 8 pm, San Diego Fire Rescue was called to the Milejo Village apartment complex. When firefighters arrived, they were able to put out the fire in about 20 minutes.

On-scene reports indicate that the fire likely started inside a unit and may have been caused by the battery of a motorized scooter.

What Legal Avenues Do Burn Victims Have Available To Them?

In a situation like the fire at the San Ysidro apartment complex, burn victims may have several legal avenues to explore for compensation and justice. These potential avenues may include:

Negligence Claims

The burn victim may file a negligence claim if it can be proven that the fire was caused by someone else’s carelessness, like the property manager or owner. If there were issues related to the maintenance of the building, such as a lack of proper fire safety measures, the property management or owner may be held liable.

Product Liability

If the fire was caused by a malfunctioning product or part of a product, like in the San Ysidro apartment fire, the scooter battery, the burn victim may pursue a product liability claim against the manufacturer, distributor, or retailer of the product. There are three main types of product defects that can be claimed:

  1. Design defects – flaws inherent in the product’s design that make it unsafe
  2. Manufacturing defects – errors that occur during production
  3. Marketing defects – failure to provide adequate warning or instruction

Premises Liability

If the apartment complex did not have adequate fire safety measures or if there were violations of building codes, the property owner or management could be held liable under premises liability. This could include:

  • Lack of functioning smoke detectors
  • Inadequate fire suppression systems
  • Poor building maintenance that contributed to the fire’s spread

“Fires like the one that occurred Sunday in San Ysidro can have devastating effects on those involved,” says Brett Schreiber, attorney at Singleton Schreiber, “we hope that the victim recovers swiftly from their injuries and that authorities can determine the source of the fire. It’s important that victims of fires, like this one, know they may have legal recourse and could consider contacting a personal injury attorney to learn more about their options.”

Fire Safety Tips For Apartment Dwellers

To enhance safety and reduce the risk of fire-related injuries, apartment dwellers may consider the following preventative and general safety practices:

  • Ensure smoke alarms work and have fresh batteries
  • Avoid overloading outlets
  • Follow safe cooking practices, like never leaving cooking food unattended
  • Practice safe candle use by always extinguishing candles when leaving the room or going to sleep
  • Promptly report any electrical issues or hazards to your landlord
  • Inspect appliance cords, replace any that are frayed or damaged
  • Keep flammable liquids in a safe, well-ventilated area away from heat sources

Wrong-way Driver on I-8 Attempts To Flee Accident Scene On Foot, Struck and Killed by Another Vehicle

Wrong-way Driver on I-8 Attempts To Flee Accident Scene On Foot

Late on Saturday, May 18th, the wrong-way driver responsible for causing a head-on collision on I-8 was struck and killed while trying to flee the accident scene near La Mesa.

Wrong-way Driver on I-8 Attempts To Flee Accident Scene On FootCalifornia Highway Patrol (CHP) reported that the incident occurred around 11:40 pm. The wrong-way driver was a male driving a white Chevrolet truck, he was traveling west in the eastbound lanes of I-8 when he hit a Honda Accord head-on just east of 70th Street.

The driver of the Honda was also a male, and he suffered major injuries in the accident. CHP said he was taken to Sharp Memorial Hospital in San Diego for treatment.

According to authorities, after the crash, the truck driver attempted to flee the scene on foot when he was hit and killed by a black Ford truck as he was running across the westbound lanes. The black Ford was driven by a male with a female passenger, neither were injured in the incident.

Authorities are unsure whether or not alcohol was a contributing factor for the wrong-way driver but have ruled it out as a factor for the other two drivers involved.

Wrong-way collisions are rare but are often caused by impaired drivers.

Wrong-way collisions are among the most devastating types of traffic accidents. Each year on California highways, an average of 43 people are killed in wrong-way crashes. Though they account for less than one percent of all deadly crashes that occur, they are shocking. Data collected from 2019 revealed that more than 61 percent of wrong-way driver crashes involved impaired drivers.

“Our hearts go out to the families whose loved ones were involved in the fatal crash on Saturday night. The aftermath of wrong-way collisions can be devastating due to the high speed of travel and the head-on nature of the crashes,” says attorney Brett Schreiber, of Singleton Schreiber, “It’s important that the victims and their families of such collisions know they may have legal recourse and could consider contacting a personal injury attorney to learn more about their options.”

Safety Measures and Public Awareness

Given the severity and potential for fatality in wrong-way driving incidents, public awareness and safety measures are essential. Some steps you can take should you encounter a wrong-way driver on the road include:

  • Staying alert: be aware of your surroundings at all times and stay vigilant for signs of potential wrong-way drivers
  • Move to safety: the majority of wrong-way crashes occur in the left lanes as the wrong-way drivers tend to think they are traveling in the right-hand lane. If you see a wrong-way driver approaching, quickly and safely move to the right, pull over on the right-hand shoulder, or exit the roadway if possible.
  • Call 911: immediately report the wrong-way driver to emergency services. Provide as much detail as possible about the vehicle and its location.

Victims and the families of victims involved in wrong-way collisions may be eligible to file personal injury claims. One Dead, One Injured in Rollover Crash Near Escondido

One Dead, One Injured in Rollover Crash Near Escondido

ESCONDIDO, Calif. — A man is dead and a woman is in the hospital after a collision between two pickup trucks in North County Tuesday morning.

One Dead, One Injured in Rollover Crash Near EscondidoCalifornia Highway Patrol said in a statement that a Chevrolet Silverado and a Ford F-150 were both driving northbound on Interstate 15 around 6:30 a.m. Tuesday when they collided south of Deer Springs Road, near Escondido.

The Ford spun out and stopped in the center divider, while the Chevrolet veered to the right and rolled over several times before ending up on the right shoulder of the road.

The Chevrolet driver, a 19-year-old man from Murrieta, was pronounced dead at the scene, police said, while a passenger, also 19, was taken to a nearby hospital with what CHP described as major injuries. The driver of the Ford, 24, was not injured.

“My heart goes out to the family of the young man who was killed in this crash,” said Gerald Singleton, the managing partner of Singleton Schreiber. “To lose a loved one so young is a heartbreak that no one should ever have to know.

“I also hope that treatment goes well for the young woman who is in the hospital, and that she is able to recover completely and quickly.”

Rollovers are a common occurrence in fatal crashes.

Data from the National Highway Traffic Safety Administration shows that in 2021, there were roughly 4,000 fatal car crashes in California. In just over 1 out of 5 fatal crashes — 859 in total — at least one vehicle rolled over, with 655 of those rollovers brought on by a collision with a vehicle or other object.

That rate is consistent with the nationwide rate of 22.2% of fatal crashes involving rollovers, per the NHTSA data.

Police have not released any further investigation results, including whether other factors like speeding, alcohol or drugs may have played a role in the crash.

“It’s crucial that police are able to get to the bottom of what happened here,” Singleton said. “That information helps clarify what legal options families might have available to them after a crash like this.

“Personal injury attorneys can help victims of car accidents sift through the uncertainty to make sure that they are receiving the compensation they deserve for expenses like medical bills, lost wages, or — should the worst happen — funeral costs”

Honolulu Bicyclist, 66, Dies After Crashing Into Open Car Door

Honolulu Bicyclist, 66, Dies After Crashing Into Open Car Door

A man who was taken to the hospital after colliding with an open car door while he was riding his bicycle May 14 has died, Honolulu police said.

Honolulu Bicyclist, 66, Dies After Crashing Into Open Car DoorThe man, 66, was riding his bicycle in the eastbound bike lane on Kalakaua Avenue when he hit the rear passenger door of a car that had stopped to let out a passenger.

The victim was in serious condition when he was transported to the hospital for treatment, but his condition slowly deteriorated, and the Honolulu Medical Examiner’s Office notified police Friday that he had died as a result of his injuries.

The victim’s death is the 12th traffic fatality of the year on Oahu, compared to 25 at this point in 2023. Police have not yet determined whether speed, drugs or alcohol were contributing factors in the accident.

“My heart goes out to the family of the victim who was out riding his bicycle,” said Paul Starita of Singleton Schreiber. “It’s devastating to lose a loved one under any circumstances, and even more so in such an unexpected way.

“In the aftermath of a tragic accident like this, families have enough to deal with in terms of managing their grief and loss without also having to worry about whether medical bills, funeral costs, or other expenses will throw them into financial limbo. That’s where personal injury attorneys come in — we are there to fight for your legal rights so you have time to focus on what’s most important.”

Preventable bicycle deaths have been on the rise for years in the U.S.

Nearly 1,000 bicyclists were killed in motor vehicle crashes in the United States in 2021, according to data from the National Highway Traffic Safety Administration, with over 41,500 additional cyclists injured in crashes. And the National Safety Council found that preventable bicycle deaths have spiked by more than 35% since 2012.

Roughly 85% of bicyclist traffic deaths happen in urban areas, which is likely driven in part by increased bike traffic sharing the roads with automobiles in those areas. Data from the American Community Survey found that bicycles were one of the fastest-growing transportation methods for commuters since 2000.
