Collision Involving a Bus and Six Other Vehicles Takes Place in Santa Cruz on Highway 17

Collision Involving a Bus and Six Other Vehicles Takes Place in Santa Cruz on Highway 17

Just after 7 am on Friday, May 31st, a bus operated by Santa Cruz Metro collided with six other vehicles when it encountered standstill traffic on Highway 17. The bus was traveling along its route from Santa Cruz to its next stop in Diridon/Downtown San Jose when it came upon unexpected traffic in the northbound left lane of Highway 17. The bus was unable to stop in time and collided with six other vehicles, according to California Highway Patrol (CHP).

The CHP reported that four people were injured in the collision, including the bus driver. All those who were injured were transported to a local medical facility.

Common Injuries In Bus Accidents

Bus accidents differ from car accidents due to the difference in size and weight between a car and a bus. Buses are heavier and larger, which means the force of the impact they deliver in a collision can cause more severe damages and injuries. Additionally, buses have the ability to carry a large number of passengers, so there is an increased likelihood of multiple injuries from a single accident.

Some common injuries sustained in a bus accident may include:

  • Whiplash and Neck Injuries: sudden jerks or stops can cause the neck to snap back and forth, leading to whiplash, which involves damage to the muscles, ligaments, and tendons in the neck.
  • Head and Brain Injuries: passengers can suffer from concussions, traumatic brain injuries (TBI), or skill fractures due to the impact.
  • Spinal Cord Injuries: the force of the collision can cause herniated discs, fractures, or even paralysis if the spinal cord is severely damaged.
  • Broken Bones and Fractures: Limbs, ribs, and other bones can break due to the impact of the accident or from being thrown inside the bus.
  • Cuts and Lacerations: broken glass, sharp metal, and other debris can cause  deep cuts and lacerations which may lead to complications.
  • Internal Injuries: blunt force trauma can result in internal bleeding and damage to organs such as the liver, kidneys, spleen, or lungs.
  • Psychological Trauma: accidents can lead to psychological issues such as post-traumatic stress disorder (PTSD), anxiety, depression.

Injuries can vary in severity depending on the specifics of the accident, including the speed of the bus, the speed of the other vehicles involved, and the nature of the collision. Emergency medical attention and follow-up care are crucial for addressing both the immediate and long-term effects of these injuries.

Obtaining Compensation For Injuries Sustained in A Collision

Depending on the circumstances of the collision, victims involved may be able to file a personal injury claim to obtain compensation for the damages and injuries they sustained. This can include compensation for things like:

  • Medical bills
  • Lost wages
  • Pain and suffering
  • Loss of consortium
  • Temporary or permanent disability
  • And more

“The crash that occurred Friday morning in Santa Cruz is unfortunate, and we hope that all those who were involved have a swift recovery,” says Brett Schreiber, attorney at Singleton Schreiber, “we believe it is important that the victims involved know they may have legal recourse and could consider contacting a personal injury attorney to learn more about their options.”

Fiery Crash on I-405 in Palms Leaves Two Dead

Dr. Charles ‘Charlie’ McMillan, Former Director of Los Alamos National Laboratory, Dies in Car Crash Early Friday Morning

Early Friday morning, May 31st, two people died in a fiery two-car collision. The crash occurred on I-405 in the West Los Angeles neighborhood of Palms, near National Boulevard. California Highway Patrol officers responded to the scene at 2:13 am where they learned a Toyota Prius and a commercial truck collided in the northbound lanes.

CHP Officer Erik Larsen said the collision caused the Prius to burst into flames, and the Los Angeles Fire Department was called. A man and woman were pronounced dead at the scene, according to Larsen. The two deceased have not yet been identified.

CHP closed all northbound lanes of the 405 freeway so crews could work to clear the scene. All lanes were reopened just after 6:30 am. Officials are still investigating the cause of the collision.

Common Causes of Car Accidents

Car accidents are a common occurrence in the United States. Data collected by the Insurance Institute for Highway Safety (IIHS) shows there were nearly 40,000 fatal motor vehicle crashes in the US in 2021, resulting in almost 50,000 deaths.

Common causes of car accidents that have the potential to result in fatalities include:

  • Distracted driving
  • Speeding
  • Drunk or drugged driving
  • Reckless driving
  • Poor weather conditions
  • Ignoring traffic signals or signs
  • Poor road conditions
  • Driver fatigue
  • Vehicle defects
  • Failure to properly check blind spots
  • And more

So, what can you do to help avoid being in a collision?

  1. Stay Focused: keep your attention on the road and avoid distractions like using your phone, eating, or changing the radio while you drive.
  2. Follow the Posted Speed Limit: adhere to the posted speed limit and adjust your speed appropriately to road and traffic conditions.
  3. Drive Sober: driving under the influence of alcohol or drugs significantly impairs your awareness and reaction time.
  4. Obey Traffic Signals: respect traffic lights, stop signs, and yield signs to avoid collisions at intersections.
  5. Avoid Driving Aggressively: stay calm and patient, even in heavy traffic. Avoid engaging in road rage behaviors like tailgating, or retaliating against other aggressive drivers.

Potential Legal Action Available to the Victims and Their Families

“Our hearts go out to the victims and the families who lost loved ones in the accident that occurred in Palms Friday morning,” says Brett Schreiber, attorney at Singleton Schreiber, “We hope officials can quickly determine the cause of the accident so that those involved can find some peace. Depending on what officials determine to be the cause of the Friday morning collision, there may be several avenues of legal action available to the victims involved and their families. Those involved could consider contacting a lawyer to learn more.”

Options available to victims and their families may include:

  • Personal injury claims – if the truck driver was injured due to another party’s negligence they may be entitled to compensation.
  • Wrongful death claims – if the accident was caused due to the negligent actions of another party, the families of the man and woman who died may be eligible to file a wrongful death claim on their behalf.
  • Employer Liability – if the accident was caused due to negligence on behalf of the trucking company, they may potentially be held liable. If the trucking company failed to provide proper training, pushed drivers to violate Hours of Service (HOS) regulations to meet deadlines, or failed to properly maintain the vehicle, they may be held liable.
  • Roadway Conditions Claims – if the accident occurred due to poor roadway conditions, governmental entities may be held responsible for causing the accident. Things such as improper design, failure to fix dangerous potholes, or to remove debris from the roadway could result in such a claim.

Officials Find Damaged Gas Line at Site of Deadly Ohio Explosion

explosion

Tuesday, May 28th, an explosion occurred in the 13-story Realty Tower building in Youngstown, killing one and leaving several others injured. Officials found a cut natural gas line in the basement of the building, but the National Transportation Safety Board (NTSB) reported it is not yet known if that played a role in causing the explosion.

Tom Chapman, an NTSB board member, said in a news conference that the line was not supposed to have gas in it, but it was found to be pressurized. Chapman reported that the line came off of the main service line which led to the Realty Tower building but did not service it.

The explosion blew out most of the ground floor, where a Chase Bank branch was located, killing an employee. The blast caused part of the ground floor to collapse into the basement and sent bricks, glass, and other debris in every direction. The upper levels of the building housed apartments.

After the explosion, first responders were on location within minutes and began search and rescue efforts. There is video footage from the bodycam of a Mahoning County deputy helping firefighters lower a ladder into a hole where the ground floor had collapsed into the basement, to rescue a woman who was trapped.

Unfortunately, a Chase Bank employee, 27-year-old Akil Drake, died in the explosion. Seven injured people were taken to Mercy Health Hospital in Youngstown on Tuesday. By Thursday, three had been released, three others were in stable condition, while one woman remained in critical condition. No further details have been released in regard to her name or injuries.

The NTSB has dispatched pipeline and hazardous materials investigators to the scene to observe the damage. Chapman said that the NTSB team would remain on the scene for around a week and issue an initial report within 30 days.

Potential Avenues of Legal Recourse for the Victims of the Youngstown Explosion and Their Families

In the aftermath of the deadly explosion at the Realty Tower building in Youngstown, several legal actions may be available to the victims and their families.

“We are devastated to hear about the explosion that occurred this week in Ohio and the loss of life and injury it caused,” says Britt Strottman, attorney at Singleton Schreiber, “Our hearts go out to the families and victims affected. We hope that officials can swiftly determine the cause and make the area safe again for everyone. It is important that the victims and their families know that they may have legal recourse, and could consider reaching out to a personal injury attorney to learn more.” Attorney Britt Strottman represented San Bruno after a major gas explosion in 2010 and helped San Bruno with the NTSB investigation after that event and formally served as a Senior Assistant Attorney General at the Ohio Attorney General’s Office.

The specifics of the legal recourse available to victims and their families depend on the findings of the investigation and the determination of liability. Some potential actions may include:

  • Wrongful Death Claim – against the utility company, contractors or third parties, or even the building owner or management company
  • Personal Injury Claims – compensation for medical expenses, lost wages, pain and suffering, and other damages from the negligent party
  • Product Liability Claims – against manufacturers, suppliers, or distributors of the defective product if it contributed to the cause of the explosion

Early Morning Crash on I-8 Leaves Semi-Truck Driver Dead

Early Morning Crash on I-8 Leaves Semi-Truck Driver Dead

Early Thursday morning, May 30th, a semi-truck traveling west on I-8 was overturned, killing the driver. Just before 3 am the incident was reported noting at least one vehicle was turned over on its side, according to a SigAlert from California Highway Patrol (CHP). The crash occurred in Mission Valley, near Hotel Circle Drive, and the Singleton Schreiber law office.

According to CHP reports, the man driving the box truck hit a curb which caused it to overturn. The driver was ejected from the vehicle and the truck slid across freeway lanes until it hit the center divider. The driver suffered major injuries and died at the scene, according to official reports.

CHP reports detailed that debris was scattered on the roadway, causing authorities to partially close some of the I-8 westbound lanes for several hours. Affected lanes were reopened by 6:15 am.

Authorities have not released the driver’s identity at this time.

Potential Avenues of Legal Recourse

“Our hearts go out to the family and loved ones of the victim of Thursday morning’s crash,” says Gerald Singleton, attorney at Singleton Schreiber, “we hope that officials can swiftly determine the cause of the crash to bring the family some much-needed peace. Depending on the findings and other details, we find it important that they know they may have legal recourse and could consider consulting with a personal injury attorney to learn more.”

In the aftermath of this tragic accident, various legal avenues might be available for the family and loved ones of the victim. These options may include:

Wrongful Death Claims

The family of the deceased driver may have the right to file a wrongful death claim. Such claims are intended to compensate the survivors for their loss, including lost wages, funeral expenses, and emotional suffering. To succeed in a wrongful death lawsuit, the family would need to prove that another party’s negligence directly contributed to the accident.

Employer Liability

If the driver was employed by a trucking company at the time of the accident, the company could potentially be held liable. Employers are generally responsible for the actions of their employees when those actions occur within the scope of employment. In this case, the trucking company might be scrutinized for possible negligence, such as failure to provide proper training, maintenance of the truck, or complying with safety regulations.

Product Liability

In some instances, a defect in the truck or its components could contribute to an accident. If a mechanical failure, such as a brake malfunction or tire blowout, played a role in this crash, the manufacturer of the truck or the defective part could be held liable under product liability laws. This would involve proving that the defect existed at the time of manufacture and that it directly led to the accident.

Roadway Condition Claims

Claims can also arise from the condition of the roadway. If the curb that the truck struck was improperly designed, marked, or maintained, governmental entities responsible for the road might be held accountable. Proving this would require a detailed investigation into the design and maintenance records of the road where the crash occurred.

Fatal Early Morning Crash on Maui Shuts Down Lono Avenue

Fatal Early Morning Crash on Maui Shuts Down Lono Avenue

Early Monday morning, May 27th, a collision between a motor vehicle and a pedestrian occurred at Lono Avenue in Kahului. Approximately just after 3 am, an unknown vehicle drove over a man lying in the roadway and did not stop after to render aid.

Fatal Early Morning Crash on Maui Shuts Down Lono AvenuePolice’s preliminary investigation has revealed that a 57-year-old male who frequented the area was lying on the road when the unknown vehicle, traveling southwest, drove over him and did not stop. The vehicle fled the scene in an unknown direction and has yet to be found or identified.

The 57-year-old male, whose identity has not yet been revealed, succumbed to his injuries on the scene.

The Maui Police Department Vehicular Homicide Unit investigators are currently investigating the incident and working to identify the vehicle and driver that fled the scene.

Fatal Hit And Run Accidents in Hawaii

Data collected from the National Highway Traffic Safety Administration (NHTSA) reveals that Hawaii is ranked number five in the nation for states with the highest rates of fatal hit and run accidents.

Hit and run accidents have a higher potential for fatalities, especially if they occur late at night or early in the morning, like the accident that occurred Monday morning. This is because, if no one else is around to render aid to the struck pedestrian, and the driver flees the scene, the pedestrian is more likely to succumb to their injuries.

Hawaii law (§291C-12.5) specifically states that “The driver of any vehicle involved in a collision resulting in substantial bodily injury to any person shall immediately stop the vehicle at the scene of the collision or as close thereto as possible but shall then forthwith return to and in every event shall remain at the scene of the collision until the driver has fulfilled the requirements of section 291C-14.”

If the driver does not stop and flees the scene, they are guilty of a class C felony, and may be subject to other penalties if the pedestrian dies or suffers severe injuries.

Legal Options For Hit and Run Victims and Their Families

If you or a loved one have been injured or killed in a hit and run accident, you may have legal options. Victims and their families may be eligible to file personal injury or wrongful death claims and obtain compensation for things such as:

  • Medical bills
  • Pain and suffering
  • Funeral expenses
  • Loss of consortium
  • Loss of financial support
  • And more

“Our hearts go out to the victim and their family of the fatal hit and run that occurred in Kahului early Monday morning,” says Julia Bryant, attorney at Singleton Schreiber, “While we know nothing can bring their loved one back and ease that pain, we hope that officials find the driver so the family may find some closure. It is important for this victim’s family, and others facing similar situations, to know that they may have legal recourse and could consider contacting a personal injury attorney to learn more about their options.”

Apartment Fire In Clairemont Mesa Leaves Two Injured

Apartment Fire In Clairemont Mesa Leaves Two Injured

A San Diego apartment fire left two people injured. A fire broke out on Thursday, May 23, in a Clairemont Mesa apartment building. San Diego Fire Rescue reported that the blaze began around 12:30 pm on the 7700 block of Belden Street, located just west of I-805 and Linda Vista Road.

Apartment Fire In Clairemont Mesa Leaves Two InjuredThe city agency reported that firefighters had the blaze under control within 15 minutes of arriving at the building.

The two injured were not identified and it is unknown how serious the victim’s injuries were. According to the San Diego Fire Department (SDFD), paramedics took one victim to the hospital.

Common Causes of Apartment Fires

Apartment fires can result from a variety of factors, often stemming from negligence, faulty equipment, or unforeseen accidents. Understanding these common causes can help residents and property managers take proactive steps to prevent fires and ensure safety. Some of the most frequent causes of apartment fires include:

  • Cooking Accidents – such as leaving cooking unattended, grease fires, stove and oven malfunctions
  • Electrical Issues – such as faulty wiring, overloaded circuits, or the use of outdated or damaged electrical appliances
  • Heating Equipment – such as space heaters being placed too close to flammable materials and malfunctioning furnaces
  • Candles – such as leaving candles unattended or placing them near flammable objects
  • Dryers – built-up lint in dryer vents or overheated dryers
  • Faulty Smoke Alarms – missing or non-functional smoke alarms can cause delayed fire detection, causing fires to become worse than they should

“Our hearts go out to everyone who suffered as a result of this fire,” says Gerald Singleton, attorney at Singleton Schreiber, “Apartment building fires can cause many individuals to experience devastating loss. We’re thankful the SDFD was able to get to the fire quickly and knock it down swiftly. While we await word on the official cause of the fire, we think it is important that the victims and their families know they may have legal recourse and could consider reaching out to a personal injury attorney.”

Possible Avenues of Legal Recourse For Fire Victims

Depending on the circumstances of the fire and what officials determine to be the official cause, victims and residents of the building may have legal recourse. Potential avenues of legal recourse may include the following.

Personal Injury Claims

Injured parties may be able to file a personal injury claim if they believe the fire was caused by negligence. To establish a personal injury claim victims will need to prove:

  • The property owner or another party owed the victims a duty of care
  • This duty was breached through negligence (like failure to maintain fire alarms, electrical safety, etc)
  • The breach of duty directly caused the victims’ injuries

Premises Liability Claims

If the fire was caused by hazardous conditions within the building that the landlord or property management could have and should have addressed, the victims may be able to file a premises liability claim. This would require proving:

  • The landlord or property manager knew or should have known about the hazard
  • They failed to take appropriate actions to remedy the hazard
  • The failure caused the victims’ injuries

Product Liability

If a defective product (like an appliance or electrical wiring) caused the fire, victims could potentially pursue a product liability claim against the manufacturer or distributor of the defective item. This would involve proving:

  • The product was defective
  • The defect caused the fire
  • The fire resulted in the victims’ injuries
