Motorcyclist Dies In Crash In Albuquerque’s Nob Hill Neighborhood

motorcycle crash

Around 8:45 pm on Tuesday, June 18, Albuquerque police responded to a fatal motorcycle crash in the Nob Hill neighborhood. According to reports, the crash occurred near Monte Vista and Marquette NE.

Police said the motorcycle was traveling at a high rate of speed heading west on Marquette. The motorcyclist then ran through the stop sign at the Monte Vista intersection where it crashed into the front passenger corner of a Toyota Corolla that was heading north on Monte Vista. The collision caused the motorcyclist to be thrown from their motorcycle across the street, where they landed on the northwest curb.

The Albuquerque Police Department spokesman, Gilbert Gallegos, said that the motorcyclist was dead when officers arrived on the scene.

The APD fatal crash team is investigating the crash.

Common Causes of Motorcycle Accidents

According to the National Highway Traffic Safety Administration (NHTSA), there were over 6,000 motorcyclists killed in 2022, making up 15% of all traffic fatalities in the nation.

Motorcycle accidents can be caused by a variety of factors, and can be the fault of both other drivers and the motorcyclist. There are significant size and weight differences between motorcycles and cars, and motorcyclists lack the protection that drivers and passengers of vehicles are afforded. Because of this, motorcyclists involved in accidents with vehicles are more likely to be hurt or even die when involved in a collision.

Some common causes of motorcycle accidents are:

  • Speeding: excessive speeds reduce the rider’s and driver’s ability to react to unexpected situations and increase the severity of accidents
  • Driving Under the Influence: operating a vehicle under the influence of drugs or alcohol can impair your judgment and slow your reaction times, which can increase the risk of accident
  • Distracted Driving: both motorcyclists and drivers can be distracted by phones, GPS, adjusting the radio, and other activities, which may lead to accidents
  • Poor Weather Conditions: rain, snow, ice, and fog can reduce visibility and traction, making the road more dangerous for both riders and drivers

Safety Tips For Motorcyclists and Drivers

It is important to remember that making the road safer for motorcyclists means both riders and drivers need to work together to make conditions safer for all.

“Our hearts go out to the family of the motorcyclist who lost their life this week,” says Brian Colón, attorney at Singleton Schreiber, a New Mexico law firm, “as a personal injury attorney, I’ve represented families who have suffered due to motorcycle collisions and seen firsthand the devastating impacts a loss like this can have on family and friends. It is important they know they may have legal recourse and should reach out to a personal injury lawyer for more information.”

Safety tips for riders:

  • Follow traffic laws
  • Wear protective gear
  • Make yourself visible
  • Stay alert and avoid distractions
  • Drive defensively
  • Perform regular maintenance checks on your bike
  • Avoid traveling in blind spots for extended periods of time
  • Use your signals

Safety tips for drivers:

  • Follow traffic laws
  • Keep an eye out for motorcyclists
  • Give motorcyclists space
  • Use your turn signals
  • Avoid distractions
  • Be cautious at intersections

17-Year-Old on Bicycle Hit By Pacific Surfliner, Dies, In Sorrento Valley

17-Year-Old on Bicycle Hit By Pacific Surfliner

On Friday, June 14th a 17-year-old bicyclist was hit by an Amtrak Pacific Surfliner train and died.

The incident occurred near the intersection of Sorrento Valley Road and Sorrento Valley Boulevard just before 1 pm. According to LOSSAN Rail Corridor Agency, Jason Jewell stated the boy was struck inside the crossing by Pacific Surfliner train 770 at approximately 12:46 pm. San Diego Police Lieutenant Jack Resch said that police responded to reports of the accident at the Sorrento Valley Boulevard grade crossing where the boy was pronounced dead at the scene.

Deputies interviewed eyewitnesses who said three boys on bicycles stopped at the crossing arms to allow a train heading north to pass. After the northbound train passed, the 17-year-old entered the tracks to cross without realizing the southbound train was approaching.

Officials have not released the name of the boy.

The Importance of Rail Safety

Every three hours a person or vehicle is hit by a train in the United States.

Unfortunately, railroad grade crossings are the most common site for accidents. Trains are large locomotives that weigh between 200 – 6,000 tons and travel at a high rate of speed. Due to their size and weight, the force of impact is very likely to cause death.

When encountering a grade crossing, safety is paramount. Some safety tips to keep in mind before crossing are:

  • Trains are bigger than their tracks: often, trains extend three or more feet from their rails, so it is important to give them a wide berth for your safety.
  • It takes trains a long time to stop: It can take trains over a mile to come to a stop, so it is important for both cars and pedestrians to not try to “beat” a train.
  • A train can pass at any time: some trains don’t have fixed travel times, and schedules for others can change often, so you should expect a train to pass at any moment.

“Our hearts go out to the family who lost their 17-year-old child this past weekend,” says Brett Schreiber, attorney at Singleton Schreiber, “as a personal injury lawyer, I’ve seen firsthand how deaths like this affect family units emotionally, mentally, and financially.

“I believe it is important to note that the family, and others facing similar situations, may have legal recourse and could consider speaking with a personal injury lawyer to learn more about their options.”

Potential avenues of legal recourse could include:

  • Wrongful Death Claim: if the train operators or rail company was negligent in any way
  • Premises Liability Claim: if the crossing where the accident occurred was found to be dangerous or improperly maintained
  • Negligence Per Se: if the defendant is found to have violated a statute or regulation designed to protect, for example, if the crossing did not comply with federal or state safety standards

Oakland Police Identify The Driver Of A Toyota Corolla Who Died In A Two-Car Collision In April 2023

Oakland Police Identify The Driver Of A Toyota Corolla Who Died
car crash accident on street, damaged automobiles after collision in city

Police have recently identified the driver who died in a late-night collision in Oakland in April 2023. The deceased, Ricardo Solis, 23, died a few days after the crash that occurred on April 14, 2023. According to authorities, the collision happened on I 580, in Oakland near Harrison Street around 3:30 am in the southbound lanes.

Authorities say that Solis was driving the Toyota Corolla and was struck by a Chevrolet Malibu. After being struck by the Chevrolet, Solis’ Corolla collided with a Toyota Tacoma, causing it to be smashed on both the front and rear ends, according to police.

Police said that the Chevrolet driver stayed on the scene and cooperated with police by giving a statement. The driver said he was traveling at the speed limit and did not notice the Toyota until it was too late.

Freeway Driving Safety Tips

The freeway can be dangerous, with many vehicles driving at high speeds, so it is important for drivers to be vigilant and drive safely. Some freeway driving safety tips:

  • Stay alert and focused: keep your attention on the road, and avoid distractions like using your phone, eating, or adjusting the radio while driving.
  • Maintain a safe following distance: keep a safe distance between your vehicle and the one in front of you. This will afford you more time to react in case the car ahead stops abruptly.
  • Follow the speed limit: Adhere to posted speed limits and adjust your speed in accordance with traffic, road, and weather conditions. Driving at a safe speed can prevent accidents and reduce the severity of collisions.
  • Use your mirrors: it is good practice to regularly check your mirrors and stay aware of the vehicles and traffic around you. This helps you anticipate the actions of other drivers and make informed decisions.
  • Avoid driving in other drivers’ blind spots: try to avoid lingering in other vehicles’ blind spots, especially large trucks. If you can’t see the truck driver’s mirrors, they most likely can’t see you.
  • Use your signals: use your turn signals to indicate lane changes and turns well in advance. This lets other drivers anticipate your movements and respond appropriately.

Legal Options Available

“My heart goes out to the family and friends of Ricardo Solis. I hope that they are able to find closure and peace,”says attorney Brett Schreiber of Singleton Schreiber, “I can only imagine how devastating it must be to find out a year later that your loved one was identified. As a personal injury attorney, I have seen how accidents like this can devastate a family. It is important that they know they may have legal action and could consider speaking with an attorney.”

Depending on the circumstances of the accident and findings authorities have discovered in their investigation, family members may be able to file a wrongful death claim

Man and Woman Hospitalized After Albuquerque Multi-Car Crash

Man and Woman Hospitalized After Albuquerque Multi-Car Crash

ALBUQUERQUE — A man and a woman were hospitalized Tuesday afternoon after a multi-car crash on Roma Avenue Northeast.

Man and Woman Hospitalized After Albuquerque Multi-Car CrashPolice and first responders were dispatched around 12:30 p.m. to a crash on Roma Avenue between Truman Street and San Mateo Boulevard. A man driving east on Roma Avenue in a Jeep SUV reportedly had a medical episode before hitting four parked vehicles and rolling over.

Local media reported that the driver and a woman who may have been a passenger in the Jeep were being transported to a nearby hospital for treatment, but were considered to be in stable condition.

A section of Roma Avenue was temporarily closed so that Albuquerque Police could conduct a crash investigation.

“We are glad to hear that the people involved in this crash seem to be stable,” said Brian Colón, managing partner of Singleton Schreiber’s New Mexico practice. “Hopefully their treatment plans are effective and return them to their loved ones quickly.”

“If you or someone you know has been involved in a crash like this, whether as a driver or as the owner of a car that gets hit, it may be in your interest to consult a personal injury attorney. We can help you identify and pursue any legal options available to you, so you can recover the money you need to deal with unexpected expenses like repair costs, medical bills or lost wages.”

Rollover crashes are responsible for nearly 3 in 10 motor vehicle occupant deaths in the U.S.

Rollovers increase the degree of danger in any crash.

A 2014 study dating all the way back to 1984 found that rollover crashes had accounted for just over 2% of all motor vehicle crashes, but 33% of the annual injury cost — with more than half of the harm coming in the form of head, neck and spine injuries.

That said, adjustments to car design and electronic stability controls since 2010 have greatly reduced the risk of rollover in many crash situations. But despite those improvements, more than 7,400 people died in rollover crashes in 2022, according to data analyzed by the Insurance Institute for Highway Safety, accounting for 29% of all motor vehicle occupant deaths.

The victim who died because of this accident was a person inside one of the five vehicles that was struck by the load. The person was pronounced dead at the scene, according to CSP reports.

Due to the overturned semi, its load, and the other involved vehicles, Highway 285 roadway was blocked through Wednesday morning.

Potential Avenues of Legal Actions Available to Victims of This Crash

There are a few potential options that victims of this accident may have in terms of legal recourse. Depending on the circumstances and the injuries they sustained, victims may file:

Wrongful Death Claim

The family of the man who died due to the accident may pursue a wrongful death claim. To pursue this claim, it will need to be determined who caused the accident. Responsible parties may include the truck driver, the trucking company, or third parties, like a parts manufacturer, maintenance company, or even municipal entities responsible for the condition of the road. In some cases, there may be multiple parties that can be held accountable.

The family may be able to recover damages such as:

  • Funeral and burial costs
  • Loss of consortium
  • Loss of income the deceased would have otherwise provided
  • And more

“Our hearts go out to the family of the victim who tragically passed away in Tuesday evening’s accident,” says Kevin Hannon, attorney at Singleton Schreiber, “we hope that the cause of the accident can be determined quickly so the family can have some closure. It is important that they, and other families facing similar situations, know that they may have legal recourse and could consider contacting a personal injury lawyer to learn more about their options.”

Personal Injury Claim

The other victims involved may be eligible to file a personal injury claim. For a successful personal injury claim, victims will need to prove who was at fault for causing the accident, these parties could also include the truck driver, the trucking company, or third parties, like a parts manufacturer, maintenance company, or even municipal entities responsible for the condition of the road.

Potential damages victims may be able to recover may include compensation for:

  • Property damage

Late-Night Fatal Accident Leaves One Pedestrian Dead in Sacramento

Late-Night Fatal Accident Leaves One Pedestrian Dead in Sacramento

A pedestrian in Sacramento, California was hit and killed by a vehicle on Monday night.

Late-Night Fatal Accident Leaves One Pedestrian Dead in SacramentoAccording to the Sacramento Police Department, officers responded to reports of a crash at Arden Way and Heritage Lane around 11:30 pm. The pedestrian who was hit died on the scene and their identity has not yet been released.

Police say that the driver remained in the area after the accident, but it is unclear at this point how the crash happened and they will continue to investigate.

Pedestrian Deaths in California

Unfortunately, California roadways see more pedestrian deaths than any other state in the US. According to the California Office of Traffic Safety, there were nearly 7,500 pedestrian deaths in California between 2009 and 2018. The pedestrian fatality rate in the state is almost 25 percent higher than the national average.

“Our hearts go out to the family of the victim who died in the crash on Monday night,” says Brett Schreiber, attorney at Singleton Schreiber, “we hope that police can determine the cause soon. As a personal injury attorney, I’ve seen firsthand how these kinds of accidents affect families and communities. It is worth noting that the victim from Monday night’s accident, and others involved in similar accidents, may have legal recourse and could consider contacting a personal injury attorney to learn more about their options.”

So what can drivers and pedestrians alike do to help make the roads safer?

Safety Tips for Drivers and Pedestrians

Working to reduce pedestrian deaths and make the roads safer for pedestrians requires drivers and pedestrians to work together. Both parties can help to protect themselves by behaving safely, making smart decisions, and adhering to the law.

Safety Tips for Drivers

  • Follow the speed limit – speeding reduces the amount of time you have to react.
  • Avoid driving distracted – avoid things like using your phone, eating, and adjusting the radio so that you can be aware of your surroundings.
  • Be on the lookout for pedestrians – part of sharing the road involves being aware and keeping your eye out for pedestrians, especially in bad weather and poor visibility conditions.
  • Yield the pedestrian’s right of way – be prepared to stop and allow pedestrians to cross when you come upon crosswalks and intersections, especially if you have a red light or stop sign.

Safety Tips for Pedestrians

  • Make yourself visible – anytime you are walking, but especially at night, wear brightly colored clothing and/or reflective clothing to help yourself stand out and be visible to drivers.
  • Stay off your phone – use your phone as little as possible because it distracts you from being aware of your surroundings.
  • Avoid behaving dangerously – opt for crosswalks instead of jaywalking, walk on the sidewalk whenever available, stay sober, and make eye contact with drivers before crossing the road to ensure they see you.
  • Look before entering the road – even if you have the right of way, check before stepping out into the road, be sure to look left and right.
