One Student Killed and Two Others Injured After Being Hit by Car Near Pershing Middle School

children walking

A tragic crash near Pershing Middle School in the San Carlos neighborhood of San Diego left one child dead and two others seriously injured Monday morning. The students were walking to school when they were struck by a vehicle near the intersection of Lake Badin and Jackson Drive just after 7:20 a.m., according to the San Diego Police.

The students, one boy and two girls, were all sixth graders walking to Pershing Middle School when the incident occurred. Police said the driver stopped immediately after the collision and rendered aid at the scene.

All three children were taken to Rady Children’s Hospital, where one of the victims, a 12-year-old boy, died from his injuries. The two surviving students suffered serious injuries, including a compound fracture to one child’s arm.

In an email to families, Pershing Middle School Principal Melanie Kray shared the heartbreaking news. She added that district counselors would be available at the campus to support students, staff, and parents.

Pershing Middle School Principal Melanie Kray Statement to Families

It is with great sadness that I share the tragic news of the death of one of our students. All of us at Pershing are heartbroken by this loss, and our thoughts are with the student’s family and loved ones during this very difficult time.

This morning, there was a traffic accident at Lake Badin and Jackson Drive involving a car and three of our students. Sadly, one student did not survive. The condition of the other two students remains unknown at this time.

The San Diego Police Department is investigating the accident. As we receive more information, we will continue to keep our families informed as appropriate.

District counselors will be on campus this week to assist students, staff and parents. The counselors will continue to provide support as needed. Please be assured that we are doing everything possible to maintain our daily routine while supporting each other as we deal with this sad event. We will be sharing additional information as it becomes available.

If you want to talk with your child about this, here are some tips that may be helpful: Provide outlets for expression such as drawing, writing and talking. Be honest. If asked difficult questions, it’s OK to say you don’t know the answers. Reassure your child of their own health and safety. Stay physically close to your child and hug them often.

We ask that you please respect the privacy of our families during this difficult time. We are a close and caring community, and we will continue to support one another through this time of grief and healing.

Sincerely,

Melanie Kray

Principal

The investigate the circumstances of the crash is ongoing, however, at this time speed or speed or alcohol involvement are not suspected to be factors.

As of Monday afternoon, a Honda sedan with a crushed windshield remained in the roadway. It has been reported that the driver of the vehicle that struck the children, a man in his 30s, did stop and tried to provide aid.

Justice, Safety, and the Difficult Road Ahead

For families, the loss of a child under such tragic circumstances is a devastation that words cannot fully describe. Accidents involving schoolchildren often bring issues of safety near school zones, traffic enforcement, and community awareness into focus.

According to neighborhood resident Tom Bruney, a parent of a student at the school interviewed by ABC10, visibility and road design might have played a factor.

“People don’t usually travel speed limit and coming over this hill, the sun is right in your eyes,” said Bruney, “My heart is, I’m fighting back tears. It’s so awful. Could easily have been my son. My heart just goes out to family of these kids.”

“Children should be safe walking to and from school each day.” said Gerald Singleton, managing partner of Singleton Schreiber. “When tragedies like this happen, it shakes an entire community. Our hearts go out to the families involved. Any family affected by such tragedy will need proper guidance to ensure that justice and accountability will drive the required safety improvements needed to prevent this from ever happening again.”

Helicopter Crashes Into Pedestrian Bridge in Huntington Beach, Injuring Several People

Helicopter Crashes Into Pedestrian Bridge in Huntington Beach

On Saturday afternoon, October 11, 2025, a shocking scene unfolded when a helicopter participating in a local event crashed into a pedestrian bridge in Huntington Beach, injuring multiple people.

According to officials, the aircraft came down around 2 pm on the pedestrian bridge located in the beach parking lot between Twin Dolphins Drive and Beach Boulevard, just across from several hotels along Pacific Coast Highway. The area was crowded at the time due to the event Cars N’ Copters, a weekend event that draws large crowds.

Video captured by witnesses shows the helicopter descending rapidly before crashing into the bridge and nearby trees in front of the Hyatt Regency Hotel. Two people aboard the helicopter were pulled from the wreckage in unknown condition, and three pedestrians sustained injuries. All five individuals were transported to local hospitals. Their conditions are unknown.

Witnesses described hearing loud “popping” sounds before the aircraft went down. “We heard this loud ‘pop, pop’,” said one beachgoer. “We turned around and just saw the helicopter come crashing down.”

Authorities confirmed that both the Federal Aviation Administration (FAA) and the National Transportation Safety Board (NTSB) have been notified and will investigate the cause of the crash.

If you or a loved one were injured in this crash or a similar aviation incident, you don’t have to face the aftermath alone. Contact Singleton Schreiber today for a free consultation to learn how our team can help you understand your legal options.

What Can Cause Helicopter Crashes?

Helicopter crashes are some of the most devastating types of aviation accidents, and often result in serious injuries or fatalities. Unlike airplanes, helicopters operate at lower altitudes, making them more susceptible to mechanical failure, pilot error, or sudden environmental changes.

Common causes of helicopter crashes can include:

  • Mechanical failures: Engine or rotor malfunctions can quickly lead to loss of control.
  • Pilot error: Misjudging altitude, speed, or weather conditions can have fatal consequences.
  • Maintenance issues: Inadequate inspections or faulty replacement parts can cause catastrophic failures.
  • Environmental hazards: Power lines, trees, and sudden gusts of wind can pose serious risks during low-altitude flight.

Because helicopters often fly over populated areas, like the crowded Huntington Beach shoreline, the risk of injuring people on the ground is high. Even a seemingly small mechanical issue can lead to extensive harm and destruction.

“When an aircraft crashes in a populated area, lives in the air and on the ground are put at risk,” says Gerald Singleton, managing partner of Singleton Schreiber. “A comprehensive investigation is essential to uncover what went wrong and to ensure the victims and their families receive the justice they deserve.”

Legal Options for Victims of the Huntington Beach Helicopter Crash

Victims injured in this crash may have several avenues for legal recourse, depending on the outcome of the investigation. In many cases, depending on the outcome of the investigation. In many cases, multiple parties can share liability, including:

  • The helicopter operator or pilot, if negligence or pilot error contributed to the crash.
  • The maintenance company, if the aircraft was improperly serviced or inspected.
  • The event organizers, if unsafe operating conditions or crowd control contributed to the risk.
  • The helicopter’s manufacturer, if a design or mechanical defect played a role in the failure.

Those injured may be entitled to compensation for medical expenses, lost income, pain and suffering, and long-term rehabilitation costs. In cases of severe or permanent injury, additional damages may be sought for future medical care and reduced quality of life.

Determining liability in aviation accidents is complex, requiring extensive investigation and expert testimony. If you or someone you love was injured in this Huntington Beach helicopter crash, contact Singleton Schreiber today for a free case evaluation.

Chinese Immigrant Huabing Xie Dies in ICE Custody at Imperial Regional Detention Facility

Huabing Xie Dies in ICE Custody at Imperial Regional Detention

Another immigrant has died while in the custody of US Immigration and Customs Enforcement (ICE), this time at the Imperial Regional Detention Facility in Calexico, California. Authorities identified the man as Huabing Xie, an immigrant from China who reportedly suffered a seizure on Friday afternoon. According to ICE, staff at the detention center performed CPR and used a defibrillator in an attempt to save him, but Xie was later pronounced dead at El Centro Regional Medical Center.

ICE stated that Xie had been detained since September after federal agents arrested him in Indio, alleging he was in the country without legal status. This detention, like many others, raises questions about the systemic practice of incarcerating immigrants, often without adequate review or consideration of individual circumstances. The agency announced that an internal investigation is underway, but has not provided further details about the cause of death or Xie’s medical condition prior to the incident.

This marks the second death in ICE custody in California within two weeks. On September 21, 39-year-old Ismael Ayala-Uribe died at a detention facility in Adelanto after reportedly having a cough and a fever. These repeated deaths reflect a disturbing pattern of inhumane conditions and inadequate medical care, highlighting systemic issues within the detention systems rather than isolated incidents. The recent deaths come amid increased concerns about medical care, oversight, and transparency at immigration detention centers across the state and nation.

Advocates and community organizations have called for greater accountability and independent investigations into conditions within ICE-run and privately operated facilities. Reports from previous years have highlighted issues such as delayed medical attention, staff shortages, and limited access for outside monitors or advocacy groups. Taken together, these reports suggest a systemic failure to uphold the basic rights of detainees, creating a cycle of wrongful detentions compounded by neglect and unsafe conditions. These ongoing concerns have renewed questions about whether proper medical oversight and emergency procedures are being followed.

“Every person in custody, regardless of immigration status, has the right to receive proper medical care and humane treatment,” said Kimberly Hutchison, attorney of Singleton Schreiber. “When detention facilities fail in that duty, the people who suffer the consequences deserve answers and accountability.”

Accountability and Legal Avenues for Families

When a death occurs in government custody, several parties may be subject to scrutiny, including federal agencies such as ICE, private contractors that manage detention facilities, and medical providers responsible for detainee care. These deaths also raise broader concerns about systemic abuse, including the widespread practice of detaining individuals without adequate legal justification or protection. In situations where negligence, inadequate medical treatment, or failure to follow safety protocols contributed to a detainee’s death, surviving family members may have grounds to pursue a wrongful death claim.

Potential legal claims could include:

  • Negligence: if detention staff, guards, or facility administrators failed to follow safety protocols, respond to medical emergencies, or provide basic care and supervision.
  • Medical negligence: if doctors, nurses, or contracted healthcare providers delayed or denied necessary treatment, or provided substandard medical care that caused harm or death
  • Civil rights violations: if conditions, confinement, or lack of oversight led to inhumane treatment.
  • Contractor liability: if a private company operating the detention center failed to meet the required standards of care.

Families pursuing such claims may seek compensation for:

  • Funeral and burial expenses
  • Loss of financial support or companionship
  • Emotional pain and suffering
  • Physical pain and lasting health complications resulting from inadequate medical care

In many cases, the physical and emotional trauma suffered by detainees, especially those who survive with long-term injuries or chronic pain, can be profound and life-altering. These damages deserve full recognition and accountability.

While the investigation into Xie’s death continues, his case underscores a recurring pattern of systemic abuse and negligence in the nation’s immigration detention system. These tragedies are not isolated, but reflect broader issues of wrongful detentions, inhumane conditions, and a failure to provide essential medical care to vulnerable populations. Each loss raises difficult but necessary questions about the government’s duty to safeguard the people in its custody and the steps that must be taken to prevent similar tragedies in the future.

If your loved one has suffered or died in immigration custody, you may have legal options. Contact Singleton Schreiber for a free, confidential case review to explore your rights and pursue accountability.

Three Critically Injured After Medical Helicopter Crashes Onto Highway 50 in Sacramento

helicopter crash

Three people were critically injured after a medical helicopter crashed onto US Highway 50 near 59th Street in Sacramento on Monday night, October 6, 2025, according to officials.

The crash occurred just after 7 pm on the eastbound lanes of the freeway, prompting a large emergency response and a full closure of the roadway. Authorities said the helicopter, operated by Reach Air Medical Services, went down without striking any vehicles.

The victims were identified as the pilot, nurse Suzie Smith, and a paramedic, two women and one man, who were all transported to local hospitals in critical condition, according to Sacramento Fire Capt. Justin Sylvia. One victim became trapped under the wreckage and was rescued with the help of bystanders, who assisted firefighters by lifting part of the downed aircraft to free the individual and move them to a waiting ambulance.

“We’re extremely lucky that there were only three victims,” Sylvia said at the scene. “It’s unfortunate they’re in critical condition, but all of our ambulances were off scene with transportation and care being performed on these victims within 20 minutes of the incident.”

Aerial footage showed the red helicopter lying on its side, the cockpit smashed, and debris scattered across the freeway. Authorities said they were thankful the aircraft’s jet fuel did not ignite, which could have resulted in a catastrophic fire.

The Dangers of Helicopter Crashes and Jet Fuel Explosions

Helicopter crashes, while relatively rare, often result in severe or life-threatening injuries when they do occur. Medical helicopters, in particular, face additional risks due to the challenging environments in which they operate, including flying at low altitudes, landing in tight areas, and often responding in poor weather or low-visibility conditions.

While in this crash, the helicopter’s jet fuel did not ignite, but in other situations, even a small spark could trigger a powerful and fast-spreading fire. Jet fuel burns at extremely high temperatures, and a post-crash explosion on a busy freeway could have endangered not just the crew but also nearby motorists and first responders.

While investigators have not yet determined what caused the crash, potential factors in helicopter accidents can include mechanical failure, pilot error, weather conditions, or issues with flight control systems. The Federal Aviation Administration (FAA) and the National Transportation Safety Board (NTSB) typically conduct in-depth investigations to determine the exact cause.

“A crash like this is a reminder of how dangerous air medical transport can be, even for highly trained professionals,” said Brett Schreiber, managing partner of Singleton Schreiber. “Helicopter crews risk their lives to help others, and when something goes wrong, the injuries are often devastating. Our firm stands ready to support those affected and ensure they get the care, answers, and accountability they deserve.”

Legal Options for the Victims of the Helicopter Crash

The victims of this Sacramento helicopter crash may have several legal avenues for recovery depending on the findings of the investigation. If the crash resulted from equipment failure, maintenance issues, or operational negligence, the victims could pursue personal injury claims to recover compensation for:

  • Medical expenses and long-term rehabilitation
  • Lost income and reduced earning capacity
  • Pain, suffering, and emotional distress
  • Future care needs and quality of life impacts

Aviation accident cases can be complex, involving multiple parties such as aircraft manufacturers, maintenance providers, and private operators. An experienced personal injury attorney can help identify all liable parties and build a strong case for compensation.

Albuquerque Man Killed in Palmdale Freeway Collision After Tesla Crash

car accident

Authorities have identified 21-year-old Danny Montoya of Albuquerque, New Mexico, as the victim of a tragic freeway collision in Palmdale, CA. The crash happened in the early morning hours of Saturday, September 27, 2025, in the northbound lanes of State Route 14, just south of Palmdale Boulevard.

According to the California Highway Patrol (CHP), Montoya had been driving a 2020 Tesla Model 3 when he was involved in a separate traffic accident. Following that initial crash, Montoya exited his vehicle and was standing in the roadway at approximately 4:35 am. A short time later, a 2008 MCI J-Series motorcoach, driven by 58-year-old F. Henriquez of Panorama City, was traveling in the lane Montoya was standing in and struck him. Montoya sustained fatal injuries and was pronounced dead at the scene.

The Los Angeles County Medical Examiner’s Office confirmed Montoya’s identity on Wednesday, October 1, 2025. CHP officials continue to investigate what led to the original crash and why Montoya was outside his vehicle when the fatal impact occurred.

Dangers of Exiting a Vehicle on a Freeway

Freeways are some of the most dangerous places to exit a vehicle. With cars and buses traveling at high speeds, even a moment on foot can put someone at serious risk of being fatally struck. Darkness during early morning hours further compounds the danger, as drivers often cannot see stranded motorists until it is too late.

When a collision leaves a vehicle disabled, drivers face an impossible choice: remain in the car and risk a secondary crash, or exit and risk being stuck while standing on the road. Both scenarios carry serious dangers, and unfortunately, Montoya found himself in this vulnerable position.

“Danny Montoya was a young driver caught in an unimaginable situation on the freeway,” says Brian Colón, managing partner at Singleton Schreiber, New Mexico (located in Albuquerque). “Even the most careful drivers can be vulnerable when a crash leaves them stranded in traffic, and his tragic death underscores how quickly a situation can turn fatal.”

Legal Options for Mr. Montoya’s Family

Families who lose a loved one in circumstances like this may have grounds to pursue a wrongful death claim. These claims can cover funeral and burial costs, medical bills, lost financial support, and compensation for the profound grief that comes with losing a family member.

“Every case is unique, and the liable party or parties can vary depending on the facts uncovered in the investigation,” says Brett Schreiber, founding partner of Singleton Schreiber, located in San Diego. “Potentially responsible parties may include another driver involved in the first crash, the operator of the motorcoach, or the other entities linked to roadway safety.”

“While no legal outcome can undo the heartbreak Mr. Montoya’s family now faces, pursuing justice can help provide answers and stability for his family after their sudden loss.”

Sacramento State Senior, Victor Manuel Castaneda, Killed After Truck Breakdown on I-5

Sacramento State Senior, Victor Manuel Castaneda, Killed After Truck Breakdown on I-5

A tragic crash on Saturday, September 13, 2025, claimed the life of Victor Manuel Castaneda, 21, a Sacramento State senior. Castaneda was driving to work when his pickup truck broke down on northbound Interstate 5, north of Sutterville Road.

According to reports, Castaneda was attempting to move his disabled vehicle toward the off-ramp when a semi-truck struck him. The impact caused his truck to catch fire, and Castaneda was unable to escape after being knocked unconscious. He died from fire-related injuries at the scene, while the tractor-trailer driver sustained only minor injuries.

If your loved one has been injured or killed in a freeway collision, contact Singleton Schreiber today to learn more about your legal rights and options.

The Dangers of Breaking Down on the Freeway

Vehicle breakdowns on high-speed roadways like I-5 are among the most dangerous situations drivers can face. With cars and trucks traveling at freeway speeds, a stopped or slow-moving vehicle can quickly become a deadly obstacle.

Collisions between passenger vehicles and semi-trucks are especially dangerous due to the massive difference in size and weight. A fully loaded tractor-trailer can weigh up to 80,000 pounds, while the average passenger vehicle weighs only a fraction of that.

Breakdowns are even riskier during nighttime or early morning hours, when visibility is reduced and drivers may be fatigued. In these conditions, truckers and other motorists have even less time to recognize a hazard and take evasive action.

Potential contributing factors in this accident may include:

  • Limited visibility– drivers may not have had time to see or react to the disabled vehicle
  • High speed differentials – trucks and cars traveling at freeway speeds may be unable to avoid stopped vehicles
  • Driver fatigue or distraction – the truck driver may not have been fully alert at the time of impact
  • Road or shoulder design – insufficient space to move the broken-down truck safely out of traffic lanes

When these factors combine, the results are often catastrophic.

Legal Options for Families After a Fatal Freeway Crash

For families like the Castanedas, the loss of a loved one is devastating. In cases like this, surviving relatives may pursue a wrongful death claim to hold negligent parties accountable.

Depending on the circumstances, liability could rest with:

  • The truck driver, if fatigue, distraction, or negligence contributed to the crash
  • The trucking company, for unsafe scheduling, poor oversight, or failure to train
  • A vehicle or parts manufacturer, if mechanical failure played a role
  • Government entities, if road design or inadequate shoulders made the area especially hazardous

Through a wrongful death claim, families may seek compensation for funeral and burial costs, lost financial support, emotional suffering, and the loss of companionship and care.

“Our hearts go out to the Castaneda family during this unimaginably difficult time,” says Brett Schreiber, founding partner of Singleton Schreiber. “Crashes between large trucks and passenger vehicles often involve extreme forces that leave occupants of the smaller vehicle with little chance of survival. In cases like this, we look closely at the actions of the truck driver, the trucking company, and even roadway safety conditions to determine who may be held responsible.”

If your family has lost a loved one in a freeway or trucking accident, contact Singleton Schreiber today for compassionate guidance and legal support.
