Car Crashes into Pacific Beach Woodstock’s Pizza Outdoor Dining Area Sunday Evening, Injuring At Least One Person

Car Crashes into Pacific Beach Woodstock’s Pizza Outdoor Dining Area Sunday Evening

Sunday evening, around 7 pm a car careened into the Pacific Beach Woodstock’s Pizza outdoor dining patio. The patio, a makeshift outdoor seating area that was one of many that popped up during covid 19, sits just inches from the street where cars pass going 35 mph.

Car Crashes into Pacific Beach Woodstock’s Pizza Outdoor Dining Area Sunday EveningAccording to San Diego Police, one person was taken to the hospital with minor injuries following the collision.

Police did not make any arrests, and investigators do not believe alcohol played a role in the crash.

Outdoor Patios in San Diego

The outdoor patios such as the one at the Pacific Beach Woodstock’s Pizza are known as parklets. Parklets sprung up all around San Diego during COVID-19 to provide ventilated eating areas for diners. However, years after the COVID-19 pandemic, the parklets are still being used regularly.

While parklets helped to save many restaurants struggling financially during the pandemic, they may be problematic now. Several cities in and around San Diego are now reconsidering parklets. Some believe it is more important to get back the extra parking spaces and deconstruct the parklets for good. This week, several cities, including Chula Vista and Encinitas, will be discussing the issue of parklets and what to do moving forward.

Legal Options Available to Injured and Affected Victims

Victims of this collision may face financial, emotional, and physical hardships in the aftermath of the accident. They may be able to take legal action to obtain damages to lessen those burdens by filing a personal injury claim.

Personal Injury Claims

If victims can successfully prove that another party’s negligence caused or contributed to the cause of the accident, they may be able to file a personal injury claim. To be successful, one would need to show that the driver or another party failed to exercise reasonable care, and thus caused the crash and injuries.

Compensation available in this type of claim may cover:

  • Medical expenses – such as emergency treatment, hospital stays, ongoing medical care, and more
  • Lost wages – income lost due to being unable to work while recovering
  • Pain and suffering – compensation for physical pain and emotional distress experienced because of the accident
  • Property damage – compensation to cover any personal property damaged in the collision
  • And more

“This accident is unfortunate and we hope for their speedy recovery,” says Brett Schreiber, attorney at Singleton Schreiber, “As a personal injury attorney, I understand that accidents can have significant impacts on the victim and their family. I believe it is important that the victim knows they may have legal avenues to pursue and could consider speaking with a personal injury lawyer to learn more about their options.”

Rail Runner Train Accident Leaves One Hospitalized in Los Lunas, New Mexico Near Highway 314

Rail Runner Train Accident

Rail Runner Train AccidentAround 4 pm on Friday, August 9th, a train collided with a vehicle in Los Lunas, New Mexico. Police are investigating the circumstances surrounding the accident.

The accident occurred near Highway 314 and Main Street, and according to Fire Chief John Gabaldon, there was only one person inside the vehicle, and they have been hospitalized. Their current condition is unknown.

The Rail Runner train was carrying 26 passengers at the time of the crash, only one passenger was assessed for injuries.

Understanding the Causes of Train vs Vehicle Collisions

Collisions between trains and smaller vehicles tend to be very serious and can result in dire injuries, significant damage, and even death. There are several causes of train versus vehicle collisions, including:

  • Signal failures – railroad crossings have signals and gates to let drivers know when it is unsafe to cross because a train is approaching. If these signals malfunction and don’t notify drivers it may lead to a potential collision because they did not receive the adequate warning.
  • Inattentive driving – engaging in distracted driving behaviors such as using a smartphone, eating, adjusting the radio, and more, can cause drivers to not see warning signals or gates and may result in drivers entering the crossing at an unsafe time.
  • Traffic congestion – in instances of heavy traffic, a vehicle may become trapped on the tracks when the crossing gate is lowered. If drivers are unable to move their vehicles in time, it can lead to a collision.
  • Poor weather conditions – inclement weather conditions such as fog, rain, or snow can create low visibility conditions that cause the driver’s view to be obscured, making it difficult to see warning signals. Overgrown vegetation near the tracks may also create poor visibility conditions.
  • Trespassing – if pedestrians or vehicles cross tracks at unauthorized locations, they increase their risk of collision with trains.

Potential Legal Options for Victims

In the aftermath of a train vs vehicle accident, victims may have to deal with physical injuries, emotional trauma, and financial strain. Taking legal action may be helpful to ease these burdens and seek justice. Possible avenues of legal recourse may include:

  • Filing an insurance claim – if the railroad company is found to be responsible, victims may be eligible to file a claim with the railroad’s liability insurance and obtain compensation for damages like injuries, lost wages, and more.
  • Negligence claims – if the railroad company, train operations, or other drivers are found to be responsible for the accident, victims can potentially file a claim against them for compensation to cover costs like medical bills, lost income, pain and suffering, and more.
  • Product liability claims – if the crossing equipment and signals or the mechanics of the train malfunction, victims may be able to file a product liability claim against the manufacturer of the malfunctioning or faulty equipment.
  • Wrongful death claims – if the victim dies due to the injuries sustained in the collision, the decedent’s loved ones may be able to file a wrongful death claim and obtain compensation for funeral expenses, loss of companionship, or loss of financial support.

“We hope that the victim in Friday’s accident is recovering from their injuries,” says Brian Colón, a Singleton Schreiber attorney, “we are confident local authorities will have a full understanding of the circumstances surrounding the accident soon.

“As a personal injury lawyer, it is important that the victim and their family know they may have legal options, and could consider reaching out to a personal injury attorney to learn more about their options.”

North County San Diego Man Struck by Vehicle While Crossing Street, Dies

North County San Diego Man Struck by Vehicle While Crossing Street

Last Monday, July 29th, 83-year-old Henry Broncy was struck by a vehicle at the intersection of Rancho Del Oro Drive and Via Rancho in Oceanside, San Diego.

North County San Diego Man Struck by Vehicle While Crossing StreetBroncy, who was crossing the street outside of a marked pedestrian crosswalk, was hit by a vehicle driven by a 46-year-old Oceanside resident just after 7:30 am.

First responders took Broncy to the hospital where he later succumbed to his injuries. The 46-year-old driver stayed at the scene of the crash and cooperated with police. According to authorities, he was not arrested and no charges are pending.

Police will continue to investigate the crash.

What Makes Pedestrian vs Vehicle Accidents Dangerous

There are several factors that make pedestrian vs vehicle accidents so dangerous, here are the key reasons:

  1. Pedestrians are extremely vulnerable – pedestrians lack any protective barriers while vehicle occupants have metal frames protecting them. This makes pedestrians much more susceptible to severe injuries from impact. Additionally, because of their lack of protection, they are at a higher risk of sustaining life-threatening injuries, or even dying.
  2. Vehicles weigh significantly more than pedestrians do, increasing the force of impact – the average vehicle weighs between 2,500 and 4,500 lbs, so even at low speeds, the force of a vehicle hitting a pedestrian is enough to inflict significant injuries. The greater the speed, the more severe the impact and increased likelihood of fatalities.
  3. Height and design of vehicles can determine injury type and severity – larger vehicles, like SUVs or trucks have higher front ends. This can cause more severe injuries to pedestrians’ heads and upper bodies and increase the likelihood of catastrophic injury or fatalities.

Unfortunately, pedestrian vs vehicle collisions are common, though they can be prevented. Both pedestrians and drivers can work together to reduce the chances of these types of accidents. Some actions that can be taken:

By pedestrians:

  • Cross streets at designated crosswalks
  • Avoid distractions and stay aware of your surroundings
  • Before crossing in front of drivers, make eye contact to ensure they see you
  • Wear clothing that helps drivers see you
  • Obey traffic signals and pedestrian signs for safe crossing
  • Use sidewalks whenever available
  • Avoid making erratic or sudden movements

By drivers:

  • Stay alert when behind the wheel and avoid distractions
  • Stop for pedestrians at marked crosswalks
  • Obey posted speed limits
  • Be aware of your surroundings
  • Exercise extra caution in poor or low visibility conditions
  • Thoroughly check blind spots

“The loss of a loved one is never easy,” says Gerald Singleton, attorney of Singleton Schreiber, “Our hearts go out to the family of the victim and we hope they are able to find closure. It is important they know they may have legal recourse and could consider contacting a personal injury lawyer to learn more about their legal options moving forward.”

Mililani Crash Leaves Four Hospitalized, Three in Critical Condition

Mililani Crash Leaves Four Hospitalized

Around 4 pm on Sunday, August 4th, a two-car collision occurred on Anania Drive in Mililani.

Mililani Crash Leaves Four HospitalizedAccording to emergency officials, the crash caused four individuals to be hospitalized. A 45-year-old man, a 42-year-old woman, and a 9-year-old boy were in serious condition after suffering multiple injuries in the accident. Additionally, a 5-year-old girl was also injured and was taken to the hospital in stable condition.

Hawaii Police Department’s Traffic Services Section released a report earlier this year showing a significant increase in major car accidents and fatalities since last year.

The data showed that major car accidents are up more than 12 percent, while traffic fatalities are up more than 100 percent. When the data was released in May 2024, there had been 366 major crashes in Hawaii so far, compared to 326 major crashes at the same time last year. At the same time, there had been a total of 15 fatal crashes, causing 17 fatalities, compared to 7 fatal crashes resulting in 8 deaths at the same time last year.

What Are Common Causes of Car Accidents?

Car accidents can happen for a variety of reasons, from distracted driving to vehicle malfunction. Understanding the causes is essential so that preventative measures can be taken to increase safety on the road. Some common causes include:

  • Distracted Driving – this is one of the main causes of accidents. Distracted driving may include engaging in activities like eating, texting, talking on the phone, or using in-car technologies while on the road.
  • Speeding – driving over the speed limit greatly reduces a driver’s ability to respond to changing road or traffic conditions, and can increase the severity of an accident.
  • Driving Under the Influence of Drugs or Alcohol – driving under the influence causes the driver’s judgment and reaction times to be impaired, increasing the likelihood of causing an accident.
  • Inclement Weather – driving in poor weather conditions such as rainy, foggy, windy, and other adverse conditions can cause roads to be slippery and greatly reduce visibility.
  • Poor Road Conditions – poorly maintained roads with potholes, overgrown plants, and more can cause drivers to lose control.
  • Vehicle Malfunctions – mechanical failures, like tire blowouts or brake failure, can cause drivers to lose control of their vehicle and may lead to accidents.

“While there has been no official word on the cause of the accident, we trust that local authorities will work quickly to determine the cause of the accident that occurred on Sunday, causing four to be hospitalized,” says Brett Schreiber, attorney at Singleton Schreiber, “Our hearts go out to the victims who have been hospitalized and we hope for a full and speedy recovery. As personal injury attorneys, we understand the significant impact a serious accident like this can have on every aspect of the victim and their family’s lives. It is important they know they may have legal recourse and could consider contacting a personal injury attorney to learn more.”

Car Salesman Struck and Seriously Injured By Man Test Driving Ford Lightning Pickup

Car Salesman Struck and Seriously Injured

Around 1:30 pm on Sunday, August 4th, a man was test-driving an electric pickup truck when he struck a car salesman in the dealership parking lot in Mission Bay.

Car Salesman Struck and Seriously InjuredAccording to San Diego Police Officer S. Foster, the driver, a 54-year-old man was test-driving a 2024 Ford F-150 Lightning. He shifted the vehicle into drive and the truck “abruptly launched forward”.

When the truck lurched forward, it struck the 31-year-old salesman. He sustained a skull fracture and brain bleed, according to Foster, and has been hospitalized.

Police are investigating the cause of the crash.

Vehicle Malfunction Accidents

While police are still investigating this accident, it’s possible that a malfunctioning component of the vehicle contributed to causing the accident.

What is a vehicle malfunction? When a vehicle’s system or component experiences a failure or defect that impairs its normal operation. It can potentially lead to safety hazards and may cause accidents or injuries.

Common vehicle malfunctions may include:

Engine Problems

The engine may experience issues like stalling when it unexpectedly shuts down. This can be caused due to fuel, air, or electrical issues. Alternatively, the engine may overheat which can inflict damage.

Transmission Issues

Transmission issues can be caused by fluid leaks when loss of transmission fluid affects vehicle performance and causes damage. Additionally, the transmission may lose power due to the inability to maintain gear engagement.

Brake System Failures

Brake system failures can be caused by worn-out brake pads. These reduce the efficiency of braking and can significantly increase the distances needed to fully stop. Brake fluid leaks can cause loss of hydraulic pressure and reduce braking efficiency. Additionally, the anti-lock braking system may fail, causing instability while braking.

Other common vehicle malfunction issues that may lead to accidents can include:

  • Tire or wheel issues
  • Steering and suspension failures
  • Electrical system malfunctions
  • Fuel system problems
  • Safety system failures
  • And more

Vehicle malfunctions can greatly impact the driver’s ability to properly and safely control the vehicle and significantly increase the risk of accidents.

“The Singleton Schreiber team sends their thoughts and well wishes to the victim and his family while he is in the hospital. As personal injury lawyers, we know the recovery process can be difficult, physically, emotionally, and financially,” says Gerald Singleton, attorney of Singleton Schreiber, “While officials work to determine the cause of the accident, we think it is important that the victim and his family know they may have legal options and could consider speaking to a personal injury lawyer to learn more.”

Head-On Crash In Sorrento Valley Injures All Six Involved

Head-On Crash In Sorrento Valley

Around 1:30 pm on Friday, August 2nd, a head-on collision occurred between an SUV and a sedan on Carroll Road in Sorrento Valley. The wreck involved a Toyota 4Runner SUV and a Toyota Model 86 sedan.

Head-On Crash In Sorrento ValleyThe collision occurred when the sedan, traveling at a high rate of speed, lost control and drifted over the double yellow lines, hitting the SUV head-on. The occupants of the SUV were part of a funeral procession on their way to the cemetery.

In total, six people were involved in the crash, five in the SUV and the driver of the sedan. All survived the head-on collision, however, two were seriously hurt. All six were hospitalized.

According to police, the driver of the sedan broke both legs, his pelvis, and his left arm. The 4Runner’s driver broke his spine, left ankle, and sternum. The passenger in the SUV broke his spine and sustained internal bleeding. Another SUV passenger suffered broken ribs and internal bleeding.

Four of the victims were transported to Scripps La Jolla, while the other two were sent to Sharp Memorial. None of the injuries are thought to be life-threatening at this point.

Police’s initial investigation indicates that speed may have played a role in the collision. An update from police later in the day indicated they determined that driving under the influence of drugs was a factor in the incident.

According to data collected by the California Office to Traffic Safety, head-on collisions are the second most common collision types when a drugged driver is involved.

“We are relieved to learn that all six people involved in this accident survived and did not sustain any life threatening injuries,” says Brett Schreiber, partner of Singleton Schreiber, “Though, they may have a long road to recovery ahead of them, they may be eligible to file personal injury claims for compensation to help them heal. Victims could consider contacting a personal injury attorney to learn more about their options.”

The victims injured by the drugged driver may be able to file for compensation to help them receive the care and treatment they need to recover. Compensation they may be able to obtain may cover:

  • Lost wages
  • Medical bills and treatment
  • Property damage
  • Pain and suffering
  • Emotional distress

In some cases ,the court may even award punitive damages. Punitive damages are intended to punish the wrongdoer and deter others from acting in similar ways. The court tends to award punitive damages when the wrongdoer’s actions were particularly egregious.
