Late-Night Fatal Accident Leaves One Pedestrian Dead in Sacramento

Late-Night Fatal Accident Leaves One Pedestrian Dead in Sacramento

A pedestrian in Sacramento, California was hit and killed by a vehicle on Monday night.

Late-Night Fatal Accident Leaves One Pedestrian Dead in SacramentoAccording to the Sacramento Police Department, officers responded to reports of a crash at Arden Way and Heritage Lane around 11:30 pm. The pedestrian who was hit died on the scene and their identity has not yet been released.

Police say that the driver remained in the area after the accident, but it is unclear at this point how the crash happened and they will continue to investigate.

Pedestrian Deaths in California

Unfortunately, California roadways see more pedestrian deaths than any other state in the US. According to the California Office of Traffic Safety, there were nearly 7,500 pedestrian deaths in California between 2009 and 2018. The pedestrian fatality rate in the state is almost 25 percent higher than the national average.

“Our hearts go out to the family of the victim who died in the crash on Monday night,” says Brett Schreiber, attorney at Singleton Schreiber, “we hope that police can determine the cause soon. As a personal injury attorney, I’ve seen firsthand how these kinds of accidents affect families and communities. It is worth noting that the victim from Monday night’s accident, and others involved in similar accidents, may have legal recourse and could consider contacting a personal injury attorney to learn more about their options.”

So what can drivers and pedestrians alike do to help make the roads safer?

Safety Tips for Drivers and Pedestrians

Working to reduce pedestrian deaths and make the roads safer for pedestrians requires drivers and pedestrians to work together. Both parties can help to protect themselves by behaving safely, making smart decisions, and adhering to the law.

Safety Tips for Drivers

  • Follow the speed limit – speeding reduces the amount of time you have to react.
  • Avoid driving distracted – avoid things like using your phone, eating, and adjusting the radio so that you can be aware of your surroundings.
  • Be on the lookout for pedestrians – part of sharing the road involves being aware and keeping your eye out for pedestrians, especially in bad weather and poor visibility conditions.
  • Yield the pedestrian’s right of way – be prepared to stop and allow pedestrians to cross when you come upon crosswalks and intersections, especially if you have a red light or stop sign.

Safety Tips for Pedestrians

  • Make yourself visible – anytime you are walking, but especially at night, wear brightly colored clothing and/or reflective clothing to help yourself stand out and be visible to drivers.
  • Stay off your phone – use your phone as little as possible because it distracts you from being aware of your surroundings.
  • Avoid behaving dangerously – opt for crosswalks instead of jaywalking, walk on the sidewalk whenever available, stay sober, and make eye contact with drivers before crossing the road to ensure they see you.
  • Look before entering the road – even if you have the right of way, check before stepping out into the road, be sure to look left and right.

Unknown Vapor Behind LA Business Hospitalizes One

Unknown Vapor Behind LA Business Hospitalizes One

Monday afternoon, just before 1 pm there was a chemical spill at a commercial facility in Los Angeles’ San Fernando Valley. Around 1 pm LA Fire Department crews arrived at the business, located in the 20700 block of W. Marilla Street. According to the LA Fire Department (LAFD), they had received reports of an “unknown vapor” coming from behind the building.

The facility housed the Firan Technology Group, a business that produces aerospace and defense electronics.

Sky5 reporter Gil Leyvas reported that 31 people were evacuated from inside the Firan Technology Group’s facility, while employees of nearby businesses were told to stay inside.

According to officials at LAFD, a 50-year-old man was transported to a local hospital due to “minor medical complaints”, while seven others declined hospitalization.

The source of the substance is still under investigation.

Potential Legal Options For Those Affected

Those affected by the unknown vapor may be eligible to file a variety of claims depending on who they are and how they were affected. Some potential avenues of legal recourse may include:

Personal Injury Claims

Those affected by the chemical exposure may seek compensation for:

  • medical expenses: this can include medical expenses they may acquire should they suffer long-term effects and need long-term medical care
  • lost wages: due to time off of work
  • pain and suffering: this can apply to the pain or suffering they experience as a result of exposure to the unknown vapor

Due to the effects on their health victims may have suffered when exposed to the unknown vapor. Even if individuals experienced minor symptoms they may be able to file claims for medical monitoring.

In order to be eligible to file a personal injury claim, victims must prove that the company was negligent in handling or containing hazardous substances. This may involve demonstrating lapses in safety protocols or improper storage of chemicals.

Workers’ Compensation Claims

Employees of the affected facility may be eligible for workers’ compensation benefits, which could cover medical treatment and a portion of lost wages. This may apply even if the employee’s symptoms are minor.

The Importance of Being Medically Evaluated

After being involved in an incident like the one that occurred Monday, it is important that victims be medically evaluated as soon as possible. “Medical evaluation is important for many reasons,” says Gerald Singleton, personal injury attorney of Singleton Schreiber, “first, it allows you to determine if you’ve suffered serious health issues and gives you the opportunity to receive prompt treatment. Secondly, it creates a solid paper trail of evidence should you decide to file a claim for compensation. As a personal injury attorney, I’ve seen firsthand how crucial it is to have medical evaluations when filing a claim.”

Alleged Drunk Driver Causes Head On Collision, Killing Another Man

Tuesday, June 4th, just before 10 pm in Ruidoso, New Mexico, an alleged drunk driver, Jadyn Wyatt Mow, caused a head-on collision that resulted in the fatality of George S. Fitzgibbon. State Police reported responding to the fatal head-on collision that occurred near 1408 Mechem Drive in Ruidoso.

Alleged Drunk Driver Causes Head On Collision, Killing Another ManAccording to New Mexico State Police, 22-year-old Mow was traveling north on Mechem Drive in a Dodge Ram pickup truck while at the same time, 46-year-old Fitzgibbon was traveling south in a Subaru. At one point, Mow crossed the center line and entered into opposing traffic, striking the Subaru head-on.

State Police reported that Fitzgibbobn died at the scene and Mow sustained only minor injuries.

After assessing the accident scene, police determined that Mow was determined to be driving while under the influence of alcohol. Mow was booked into the Lincoln County Detention Center and is being charged with DWI, resulting in great bodily harm or death.

Wrongful Death Claims

Family members who have wrongfully lost their loved one due to another person’s negligence may be eligible to file a wrongful death claim. These claims seek to provide compensation for the survivors’ loss, including lost wages from the deceased, lost companionship, and funeral expenses.

To establish a wrongful death claim, generally, the family must prove the following elements:

  • Duty of Care: The plaintiff must show that the defendant owed a duty of care to the deceased.
  • Breach of Duty: it must be demonstrated that the defendant breached this duty of care.
  • Causation: the plaintiff must prove that the defendant’s breach of duty directly caused the death of the deceased.
  • Damages: the plaintiff must show that they suffered damages as a result of the death.

“Our hearts go out to the family who lost their loved one in Tuesday night’s collision,” says Brian Colón, an attorney at Singleton Schreiber, “As a personal attorney, I’ve seen the devastating impact a fatal DWI accident can have on family members and the community. I’ve held the hand of a mother who buried her child due to the recklessness of a drunk driver. It is important that the Mow’s family, and families in similar situations know, that they may have legal recourse, and could consider contacting and experienced wrongful death attorney to learn more about their options.”

Fatal East County Collision Between Car and Motorcycle

Fatal East County Collision Between Car and Motorcycle

On Monday, June 3rd, a motorcyclist died after being involved in a collision with a car making a left turn. According to California Highway Patrol (CHP), the crash occurred around 5:45 pm near Campo, on Old Highway 80 near the Golden Acorn Casino.

Fatal East County Collision Between Car and MotorcycleOfficer Jared Grieshaber said that a 78-year-old woman from Imperial was slowly driving in a Toyota Corolla south on Old Highway 80 when she began a left turn into the casino parking lot. When she did this, she turned directly in front of a 54-year-old man who was riding a 2022 Harley Davidson heading north.

Grieshaber said the motorcyclist slammed into the front of the Toyota, sending the rider off his bike and into the road.

The 54-year-old motorcyclist died at the scene, his name has not yet been released.

The 78-year-old woman was taken to a local hospital to be treated for minor injuries. Police believe neither drugs nor alcohol played a role in this accident.

Motorcycle Fatalities in California

Data collected by the National Safety Council shows that in 2022, California experienced the second-highest number of motorcycle deaths, with 634 fatalities, following Florida, which had 668 fatalities.

While riding a motorcycle is exhilarating, it is also dangerous. Motorcycles lack the protectiveness that is afforded to passengers of vehicles. If involved in a collision with a car or truck, motorcyclists are much more likely to suffer catastrophic or even fatal injuries.

Common Causes of Motorcycle Accidents

Motorcyclists often get a bad reputation and are wrongfully blamed for causing accidents, however, accidents involving motorcycles are usually caused by the vehicle driver’s error.

“Our hearts break for the family of the motorcyclist who was involved in Monday’s fatal accident,” says Brett Schreiber, attorney at Singleton Schreiber, “accidents like this are not only emotionally devastating but can be financially devastating as well. It is important that the family know they may have a wrongful death claim and could consider speaking to an experienced wrongful death attorney to learn more about their options.”

So, what commonly causes motorcycle accidents?

  • Distracted driving: if drivers are not paying attention by engaging in activities like using their phone, eating, or adjusting the radio they may not notice motorcyclists in their vicinity.
  • Rear-end collisions: if a car is following too closely, it can rear-end a motorcycle, especially if the motorcyclist has to stop suddenly for some reason.
  • Lane changes: cars changing lanes without checking their blind spots can cause them to collide with motorcyclists who are in their blind spot or lane splitting.
  • Failure to yield: drivers often fail to yield the right of way to motorcyclists, especially at intersections.
  • Left-hand turns: this is one of the most common causes, when a vehicle makes a left-hand turn in front of an oncoming motorcycle, often due to the driver not seeing the motorcycle or misjudging its speed.

Motorcyclists Dies After Rear-Ending Car on H-1 Freeway

Motorcyclists Dies After Rear-Ending Car on H-1 Freeway

Early Saturday, June 1st, a 44-year-old motorcyclist died on the H-1 freeway after crashing into another vehicle. Authorities said the accident occurred near Waipahu.

Motorcyclists Dies After Rear-Ending Car on H-1 FreewayA Honolulu Police Department report stated that around 1:55 am a 50-year-old male was traveling west on H-1 Freeway in his vehicle when he slowed down due to a previous accident that had occurred on the road. When he slowed down, he was rear-ended by a 44-year-old male motorcyclist traveling west at a “high rate of speed”.

The 44-year-old man driving the motorcycle was ejected from his bike in the collision and died at the scene. Officials from Honolulu Emergency Medical Services said paramedics responded to the scene and assisted with the pronouncement of death.

Honolulu Police stated there is an ongoing investigation, though it does appear that speed was a factor in the collision. They do not yet know if alcohol or drugs were factors.

Common Causes of Motorcycle Accidents

According to the National Highway Traffic Safety Administration (NHTSA), there were 5,932 motorcyclists killed in traffic fatalities in 2021 in the US. The Hawaii State Department of Transportation (HDOT) data shows that in 2022 there were 33 fatal motorcycle, motor scooter, and moped accidents. Of those 33 fatalities:

  • 22 of the riders were not properly licensed to operate the vehicle
  • 18 tested positive for alcohol, drugs, or both in preliminary toxicology screens
  • 19 of the fatal accidents had speed as a contributing factor
  • 24 riders were not wearing helmets at the time of the crash

“Our hearts go out to the family of the motorcyclist involved in the fatal accident that occurred on Saturday morning,” says Paul Starita, Attorney at Singleton Schreiber, “as a personal injury lawyer, I’ve seen firsthand how a devastating accident like this one can affect all those involved. It is important that the victims involved and their families know that they may have legal recourse and could consider contacting a personal injury lawyer to learn more.”

Unfortunately, fatal motorcycle accidents are not uncommon on Hawaii roads. Some of the most common causes include:

  • Speeding: traveling at excessive speeds can reduce the motorcyclist’s ability to react to hazards and traffic flow changes, and increase the severity of collisions when they occur. Similarly, vehicles traveling at excessive speeds significantly decrease the driver’s ability to react, and increase the force of impact should they collide with a motorcyclist.
  • Alcohol and Drug Use: being under the influence of drugs or alcohol can cause impaired judgment and delayed reaction times in both vehicle drivers and motorcyclists, and can contribute significantly to motorcycle accidents.
  • Road Hazards: potholes, uneven pavement, debris, and other road hazards can cause motorcycles to lose control more easily than cars.
  • Distracted Driving: both motorcyclists and other vehicle drivers who are distracted by activities like texting, eating, or using other in-car technologies increase their risk of being involved in an accident
  • And more

Possible Course Of Legal Action For Those Involved

Those involved in accidents like the one that occurred on Saturday may be able to file claims such as:

  • Wrongful death claims: if the motorcyclist’s death was a result of another person’s negligence. For example, if the car that slowed down for the previous accident did not have functioning brake lights, or if government entities failed to adequately signal to slow down for the accident, or their delayed response to the initial accident played a role in the fatal crash. The family may be able to obtain compensation to cover funeral and burial costs, along with other damages.
  • Personal injury claim: if the driver of the vehicle that stopped for the initial accident sustained injuries or damage due to the rear-end collision.

Suspected DUI Driver Runs Red Light in Pacific Beach, Hitting Two Pedestrians

Suspected DUI Driver Runs Red Light in Pacific Beach, Hitting Two Pedestrians

Just after 2 am on Saturday, June 1, a man and woman crossing Grand Avenue in Pacific Beach were hit by a suspected drunken driver who ran a red light.

The 30-year-old woman and 28-year-old man were lawfully crossing the street at the Grand Avenue and Bayard Street intersection when a 28-year-old man, suspected of drunk driving, ran a red light in his Ford Explorer and hit them, according to police Officer Sarah Foster. The driver continued driving, leaving the scene. He was arrested by police shortly after, near the 3700 block of Ingraham Street.

Both pedestrians flew in the air after the collision, causing them to suffer serious injuries. They were transported to the hospital. The 30-year-old woman suffered a skull fracture along with numerous other broken bones. According to Foster, her injuries were considered life-threatening.

Potential Legal Recourse Available to Victims of DUI Accidents

“My heart goes out to the pedestrians who were hit and injured in the suspected DUI accident on Saturday morning,” says Brett Schreiber, attorney at Singleton Schreiber, “as a personal injury attorney, I’ve seen how incidents like this can turn people’s lives upside down. My thoughts are with the victims and their families as they begin their road to recovery.

“I believe it is important that the victims of this accident, and victims of similar accidents, know that they may have legal recourse and they could consider contacting a personal injury attorney to learn more about their options.”

DUI accidents can have severe, sometimes even deadly, consequences. In the accident that occurred on Saturday, the victims were pedestrians hit by a vehicle on the road. Pedestrians are especially vulnerable in these kinds of accidents due to the significant size and weight difference between their bodies and the vehicle that hits them, with the average weight of a car being 4,000 pounds.

Victims of DUI accidents may be able to file personal injury claims to obtain compensation for damages such as:

  • Medical expenses: costs for immediate treatment, ongoing medical care, rehabilitation, and any future medical needs related to the injuries sustained in the accident.
  • Lost wages: compensation for the income they lost due to the inability to work while recovering from the injuries.
  • Pain and suffering: non-economic damages for physical pain, emotional distress, and mental anguish caused by the accident and injuries.
  • Loss of consortium: compensation for the negative impact on the victim’s relationship with their spouse or other family members.

In some cases, if the involved victim dies due to the injuries they sustained in the accident, their family may be eligible to file a wrongful death claim for damages including:

  • Funeral and burial expenses: costs associated with the deceased’s funeral and burial.
  • Loss of financial support: compensation for the income the deceased would have provided to their family.
  • Loss of companionship: damages for the emotional and psychological impact on the family members due to the loss of their loved one.

If you or a loved one have been injured in a DUI car accident and suffered a personal injury, call the San Diego pedestrian accident attorneys at Singleton Schreiber today at (619) 771-3473 or by email at info@singletonschreiber.com to learn more about your options.
