Multi-Vehicle Crash in Albuquerque I-40 Causes Death of 26-Year-Old Chamar Gallegos

Multi-Vehicle Crash in Albuquerque I-40 Causes Death of 26-Year-Old Chamar Gallegos

On Friday, September 20th, just before 5 pm, a multi-vehicle collision occurred near the Big-I (a freeway interchange) on Interstate 40 in Albuquerque, ultimately leading to the death of one woman, identified as 26-year-old Chamar Gallegos.

According to New Mexico State Police (NMSP) officials, Gallegos was driving her Honda Civic east approaching the interchange to head north on Interstate 25 where traffic was backed up. Reports say the Civic did not slow down and rear-ended a GMC SUV, causing a chain-reaction crash with three other vehicles waiting in traffic.

NMSP said that Gallegos was not wearing her seatbelt and died due to the injuries she suffered in the crash. No other injuries were reported in the crash.

Officials will continue to investigate the collision for more information.

The Impact of Rear-End Collisions in New Mexico

Rear-end collisions in New Mexico are the most common type of collision to occur. Data collected by the New Mexico Department of Transportation for 2022 shows that over 33 percent of crashes that occurred in the state that year were rear-end collisions. Rear-end collisions also accounted for over 18 percent of fatal crashes, and 33 percent of injury crashes.

Rear-end collisions can occur due to a variety of factors, including:

  • Distracted driving
  • Speeding
  • Driving under the influence of drugs or alcohol
  • Poor weather or road conditions
  • Tailgating or following too closely
  • Mechanical issues
  • Drowsy driving
  • And more

“Fatal rear-end collisions, especially those like the one involving Chamar Gallegos where drivers do not see stopped vehicles ahead or fail to react in time, can have a devastating impact,” says Brian Colón, New Mexico managing partner and lawyer of Singleton Schreiber, “not only on the victims involved but also their families. The impacts may include physical injury, financial strain, and emotional trauma. These types of accidents are a stark reminder of the need for heightened awareness and caution, especially on busy interchanges and freeways.”

Legal Avenues Available to Rear-End Collision Victims and Their Families

Victims of rear-end collisions and their families may be entitled to pursue compensation for the damages they suffer in the accident. In cases where the victim(s) are injured, they may elect to pursue a personal injury claim. A personal injury claim may allow them to obtain compensation for damages they suffered due to the accident, such as:

  • Medical bills
  • Lost wages due to extended time off of work for recovery
  • Pain and suffering
  • Emotional suffering
  • And more

In cases where the victim unfortunately dies in the accident, their family may choose to pursue a wrongful death claim. A wrongful death claim may allow the family to obtain compensation for damages including:

  • Funeral and burial expenses
  • Loss of companionship
  • Future financial support
  • And more

Potentially liable parties for wrongful death claims may include:

  • The driver who caused the collision
  • The car manufacturer if the collision occurred due to a malfunction (such as brakes giving out)
  • The mechanic or repair shop, if improper maintenance or repairs contributed to the accident
  • Government entities, if poor road design, maintenance, or hazardous conditions played a role in the collision

If you have been injured in a rear-end collision in Albuquerque or unfortunately lost a loved one in a rear-end collision, you may be eligible to file a claim. 39-Year-Old Marco Antonio Caballero Flores Dies In Head-On Collision On Highway 58

head on collision

Bakersfield, CA | September 20, 2024

Saturday, September 14, 2024, around 2 am Marco Antonio Caballero Flores was involved in a head-on collision with another vehicle on Highway 58, just east of Edison Road. Unfortunately, Flores was pronounced dead at the scene.

California Highway Patrol officials of the Bakersfield area are investigating the cause of the crash.

The Dangers of Head-On Collisions

In 2021, fatal collisions in Bakersfield killed or injured more than 1,800 people. In head-on collisions, even though they make up a smaller percentage of overall accidents, they account for a disproportionate number of fatalities. In the US, head-on collisions account for around 14 percent of traffic fatalities.

Causes of head-on accidents can be attributed to several factors, such as:

  • Wrongway driving: Drivers may mistakenly enter a freeway going the wrong way, often due to confusion or impaired driving.
  • Distracted driving: When drivers take their eyes off the road to use a phone, adjust settings, or engage in other distractions, they may drift into oncoming traffic.
  • Driving under the influence: Alcohol or drugs impair driver’s judgment and reaction times, leading to an increased risk of wrong-way or unsafe passing that results in head-on crashes.
  • Fatigue: Tired drivers are more likely to swerve out of their lanes, especially on long stretches of highway, leading to head-on collisions.

“Head-on collisions are dangerous and often lead to severe injuries or death, like the case of Marco Antonio Caballero Flores,” says attorney Brett Schreiber of Singleton Schreiber. “These types of accidents are especially devastating, because often they could have been prevented. In many cases, simple actions can make all the difference. Our thoughts go out to Mr. Flores’ family in this difficult time. We are confident that CHP will quickly determine the cause of the accident and provide his family with closure.”

Legal Recourse Available to Victims of Head-On Collisions & Their Families

Victims of head-on collisions and their family members may be entitled to pursue legal action to obtain compensation for the damages they suffered in the accident. In cases like Mr. Flores’ families may be able to file a wrongful death claim. These types of claims may allow them to obtain compensation for funeral expenses, loss of companionship, and the financial support the deceased would have otherwise provided.

In cases where the victim survives, they may be able to file a personal injury claim and obtain compensation for things such as medical expenses, rehabilitation costs, lost wages, pain and suffering, and more.

Airport Fire Victims Charlie and Nikki Hoey Speak Out About Losing Their Home to The Blaze

Airport Fire Victims Charlie and Nikki Hoey Speak Out About Losing Their Home to The Blaze

Two Airport Fire victims have spoken up about their experience losing their home in the Southern California blaze. The Airport Fire, which broke out on Monday, September 9th in Orange County on Trabuco Creek Road, has since scorched over 23,500 acres of land and destroyed more than 150 structures.

Victims Charlie and Nikki Hoey, husband and wife, lost everything in the span of a few hours on Wednesday, September 11, 2024. As the Airport Fire continued to spread, it made its way over the ridge down into Riverside County. The Hoeys say they had less than an hour to pack what they needed and evacuate their home, narrowly escaping the flames as they descended.

Charlie Hoey noted the losses they experienced were even more devastating due to so many of the items lost being family items handed down from grandparents.

Legal Options Available for Homeowners Affected by the Airport Fire

Wildfires can have disastrous effects, especially when homes are affected. The losses homeowners face in the wake of such events can be devastating, not only financially, but emotionally, as well. The costs of evacuating, temporary housing, and rebuilding after the fire can be immense. Those affected by the airport fire may have legal avenues available to them to help recover the damages they have suffered. Victims of the Airport Fire may potentially seek compensation for expenses including:

  • Property Damage: this may include compensation for the loss of homes, vehicles, and other personal belongings such as irreplaceable family heirlooms.
  • Temporary Housing: this may include compensation for the cost of temporary housing, food, and other costs associated with obtaining emergency lodging in a safe location away from the fire.
  • Emotional Distress: losing a home and significant personal items can cause emotional trauma, which may be considered when seeking compensation for non-economic damages.

“Wildfires wreak havoc on the lives of victims in their path,” says managing partner and attorney, Gerald Singleton, of Singleton Schreiber, “our team is heartbroken for the many individuals and families who’ve lost everything to the Airport Fire. We understand that the effects of this kind of loss can be devastating and cause financial and emotional turmoil. Victims who’ve lost their homes and belongings may wish to pursue a claim to obtain compensation for the losses they’ve suffered due to the fire.”

Dr. Charles ‘Charlie’ McMillan, Former Director of Los Alamos National Laboratory, Dies in Car Crash Early Friday Morning

Dr. Charles ‘Charlie’ McMillan, Former Director of Los Alamos National Laboratory, Dies in Car Crash Early Friday Morning

Dr. Charles “Charlie” McMillan, director of Los Alamos National Laboratory (LANL) died after being involved in a two-car collision in the early morning of Friday, September 6th.

The fatal crash occurred around 5:15 am. The Los Alamos Police Department (LAPD) received reports of a two-vehicle accident on New Mexico State Route 502, near the Camino Entrada intersection.

Two individuals were taken to the Los Alamos Medical Center for treatment, a 22-year-old female, and a 69-year-old male, identified as Dr. McMillan. The 22-year-old sustained minor injuries, however, Dr. McMillan succumbed to his injuries and was pronounced dead at the hospital.

LAPD’s crash team is still investigating the cause of the collision.

The Impact of Fatal Car Accidents in New Mexico and Los Alamos

Fatal car accidents remain a pressing issue in New Mexico and its communities, including Los Alamos. The tragic death of Dr. McMillan serves as a stark reminder of the dangers New Mexico drivers face each day on the roads and highlights the need for greater emphasis on traffic safety.

New Mexico consistently ranks among the states with the highest rates of traffic fatalities, with more than 500 traffic-related deaths reported in 2023. This statistic highlights significant public safety issues and the importance of implementing legal and regulatory measures to address them.

In smaller communities like Los Alamos, fatal accidents can have a profound impact. The close-knit nature of these communities often amplifies the emotional and legal ramifications of such tragedies.

“This tragic incident serves as a powerful reminder of the inherent dangers on our roads,” says Michael Duran, attorney at Singleton Schreiber, “Injured drivers on New Mexico roads deserve not only justice but also closure after such a collision with devastating consequences. We are confident the LAPD will work hard to quickly determine the cause of the collision. Our thoughts are with those affected by this tragedy.”

Safe Driving Practices

Staying safe on the road is important, and while accidents happen, there are practices every driver can implement to increase safety on the road. Some safe driving practices that every driver can use include:

  • Adhering to posted speed limits
  • Driving sober
  • Avoiding the use of distractions
  • Signaling intention to other drivers
  • Maintaining a safe following distance
  • Obeying posted signs and signals
  • Checking blind spots before changing lanes
  • Adjusting speed and following distance according to weather conditions
  • Ensuring your vehicle receives regular maintenance
  • And more

Airport Fire in Orange County

Airport Fire in Orange County

September 16, 2024 – On Monday, September 9, 2024, a fire was ignited in Orange County near the Trabuco Flyers Club on Trabuco Creek Road. Orange County Public Works employees were using a loader to place a load of boulders heavy as barriers restricting access to the vegetation off Trabuco Creek Road. The loader started letting out smoke and sparked, which started the fire.

According to Orange County Fire Authority Deputy Chief, TJ McGovern, the fire was deemed as “unintentional”. McGovern stated that the OC Public Works employees attempted several times to extinguish the fire after noticing it sparked by using fire extinguishers and loaders while 911 was being contacted.

As of September 16, 2024, the fire is 31% contained and has scorched 23,519 acres of land. Recent colder weather and light showers have helped slow the fire’s spread. Fire officials estimate that the fire will be fully contained by September 24.

There are more than 770 personnel assisting to get the fire under control, along with 10 helicopters, 134 engines, and more. Confirmed damage includes six structures, residential, commercial, and other, as well as 10 firefighter injuries and two civilian injuries.

Thus far, 160 structures have been destroyed and 34 damaged.

Dangers of Wildfires in California

Wildfires are a persistent and growing problem in California, especially in recent years as the state faces prolonged droughts and increased temperatures. These fires not only destroy vast amounts of land but also endanger lives, properties, and entire ecosystems. As seen in the recent Airport Fire in Orange County, fires can start unexpectedly and spread rapidly.

Several factors contribute to the occurrence of wildfires:

  • Human activity: whether through negligence, unintentional accidents, or illegal activities, many California wildfires are sparked by human activity.
  • Natural causes: extreme heat, lightning strikes, and high winds often contribute to the start and spread of wildfires.
  • Electrical failures: power lines and electrical equipment can create sparks that ignite dry brush or vegetation and lead to large-scale fires.

Wildfires can cause widespread devastation and often lead to the loss of homes, businesses, and even lives. Wildfires can have long-term effects on air quality, water supplies, and the overall health of the affected communities.

Potential Injuries and Damages Available to Victims of Wildfires

Wildfire victims often suffer both physical and financial harm, and they may be entitled to compensation depending on the circumstances surrounding the fire. The types of injuries and damages can vary greatly based on the severity of the fire and the level of destruction it causes.

“Wildfires like the Airport Fire can have devastating consequences for both individuals and communities. This fire highlights the importance of accountability and safety measures to prevent such disasters,” says Gerald Singleton, Managing Partner and attorney of Singleton Schreiber, “Those affected by the destruction– whether through injury, property damage, or loss of a loved one – deserve to understand their rights and seek compensation for the harm they’ve endured. Our hearts go out to everyone impacted by this fire as they navigate the difficult path to recovery.”

Some potential injuries and damages available to victims include:

  • Physical injuries – such as burns, respiratory issues from smoke inhalation, and trauma from escaping dangerous conditions. Victims may need long-term medical care, rehabilitation, and ongoing treatment for these injuries and may be able to recover compensation to cover those expenses.
  • Property damage – such as destruction of homes, vehicles, personal belongings, businesses, and more. Compensation victims may be able to recover for this type of damage may include repair or replacement costs for lost property, like rebuilding homes or recovering damaged personal items.
  • Wrongful death claims – in cases where wildfire causes death, the deceased’s family may choose to pursue a wrongful death claim. This can allow them to seek compensation for funeral expenses, loss of companionship, loss of financial support, and more.

Pedestrian Killed in Kihei, HI Identified as Irene Kauffold

Pedestrian Killed in Kihei, HI Identified as Irene Kauffold

At approximately 7:23 p.m. Thursday, September 5, 2024, a pedestrian was struck by a 2002 Jeep Grand Cherokee on Keala Place near S Kihei Road in Kihei, Hawaii.  The Jeep, driven by Keith Tanitomi (61) veered onto a sidewalk where it struck the pedestrian, a 64-year-old female,  causing critical, life-threatening injuries.  She was transported to the Maui Memorial Medical Center Emergency Room for treatment where she later succumbed to her injuries.

On September 7, the Maui Police Department identified the victim as 64-year-old Irene Kauffold.

Tanitomi fled the scene but was arrested the following day, facing multiple charges, including Negligent Homicide, Reckless Driving, and outstanding warrants.

A Tragic Loss of Life

This tragic incident is another in a string of hit-and-run collisions involving pedestrians in the Kihei area.  In April, a 34-year-old woman was left fighting for her life after she was struck on South Kihei Road near Namau’u Place.  Just weeks before, a 50-year-old man was found dead after being struck on Piikea Avenue.

Pedestrian collisions are a concern in Kihei, as in many other areas of Maui, particularly due to the town’s combination of busy roads, tourist traffic, and pedestrian activity. South Kihei Road, a major thoroughfare, can see high volumes of both vehicular and pedestrian traffic, which increases the risk of accidents.

That all three of these collisions involved hit-and-run drivers is also, unfortunately not surprising.  In fact, nationally, nearly 1 in 4 pedestrian deaths involve a hit-and-run driver.   There are many reasons why drivers leave the scene in pedestrian crashes. They may panic or fear the gravity of what has happened and the legal consequences. They may be under the influence of drugs or alcohol.  A lack of witnesses, especially in rural or low-light situations, may make them feel as though they can get away with it.  Or even, as was the case in this situation, the driver may have existing legal or financial concerns.

Irene Kauffol and Her Family Deserve Justice

According to Brett Schreiber, Partner at Singleton Schreiber, whatever the reason a driver leaves the scene, it makes a tragic situation more difficult. “Unfortunately, when a collision occurs, drivers may panic and flee the scene, turning tragic accidents into hit-and-run cases that make it even harder for victims and their families to seek justice,” he said.

While the driver of the vehicle that killed 64-year-old Irene Kauffold has been arrested and will face charges, the criminal justice system cannot help with the often devastating financial fallout of the sudden loss of a loved one.  In this case, her family may have other options to pursue justice.  This may include:

A Wrongful Death Claim to seek compensation for funeral and burial expenses, loss of financial support, loss of companionship, and mental anguish

Restitution in Criminal Proceedings if the driver is prosecuted and convicted for the hit-and-run.

Third-Party Liability if another party such as a bar that overserves a patron or a local government that failed to address a known road hazard.

“We understand that it can be incredibly difficult to think about the legal process when losing a loved one,” Mr. Schreiber went on to say. “However, victims and their families do not deserve to bear the financial burden of such a situation.”

If you are dealing with the tragic and sudden loss of your loved one in this or a similar incident, an attorney can be an invaluable resource.  At Singleton Schreiber, attorneys like Mr. Schreiber have dedicated their careers to helping those whose lives have been changed through no fault of their own.  They offer a free, no-obligation consultation and are ready to listen to your story and do everything they can to help.  Call (808) 582-8062 when you are ready.
